2601-2 <br />5. Any act otherwise prohibited by this Ordinance, provided it is not otherwise <br />prohibited by statute shall be lawful if performed under, by virtue of and strictly <br />within the provisions of a City permit to do so, and to the extent authorized thereby. <br /> <br />2601.030. HOURS AND ACCESS. <br /> <br />1. The recreation and education opportunities of the park shall be available to all <br />members of the public regardless of race, sex, age, creed, national origin or place of <br />residency. <br /> <br />1. Regular park hours are The parks shall be open to the public from 6:00 a.m. to 10:00 <br />p.m. one-half (1/2) hour before sunrise until one-half (1/2) hour after sunset. No <br />person or vehicle shall remain, stop, use, or be present within the confines of any <br />park at any other time. An exception to this shall apply to the tennis courts which <br />shall remain open until 10 p.m. Other exceptions may be made at the discretion of <br />the City in the case of emergency or when special use permits have been authorized <br />or for other reasons the City may determine necessary or desirable. <br /> <br />3. Any section or part of any park may be declared closed to the public by the City at <br />any time or for any interval of time, either temporarily or at regular and stated <br />intervals, and either entirely or for certain uses as the City shall find necessary. <br /> <br />2601.040. PERMITS. Permits shall be required for the exclusive use of all or portions of <br />specific areas, buildings and other park facilities; and for conducting special events of a cultural, <br />educational, political, religious or recreational nature; and for specific exemption from any provision <br />of this Ordinance. Any person, group or association of persons required to obtain a permit shall file <br />an application for such permit with the City Administrator. <br /> <br />The grantee of a permit shall be bound by this Ordinance and any applicable regulations in <br />force as though the same were inserted in said permit. <br /> <br />The grantee of a permit shall be liable for any loss, damage, or injury sustained by the park or <br />by any person whatever, by reason of the negligence of the person or persons to whom such permits <br />are issued. <br />The grantee of a permit shall not transfer or relinquish said permit to another person or group <br />of persons without the written permission of the City. <br /> <br />The City shall have the authority to revoke a permit upon evidence of good cause. <br /> <br />No person shall in any manner disturb, harass, or interfere with the grantee of a valid permit, <br />nor with any of the grantee's property or equipment. <br /> <br />Permits for shelter reservations shall be subject to the additional rules and guidelines as <br />referenced in the Park Shelter Rental Guidelines document.
