<br /> <br /> <br />STAFF REPORT <br /> <br />TO: Mayor Keis and Members of City Council <br />FROM: Bill Dircks, Public Works Director <br />DATE: March 7, 2019 <br />RE: Ordinance 837, Revision Chapter 1501, Filling, Grading, and Excavating Operations <br /> <br />ACTION TO BE CONSIDERED: <br />Adopt Ordinance 837, Amending Chapter 1501, Filling, Grading, and Excavating Operations <br /> <br />BACKGROUND: <br />The filling, grading and excavation operations ordinance had a fee schedule contained in it and that fee <br />schedule had not been revised in many years. The City’s policy is to keep all fees as part of the fee <br />schedule so that it can be easily amended each year as needed. The removal of the fee schedule also led <br />to revising the entire ordinance to match it up to current practices. <br /> <br />Highlights of the revisions include: <br /> <br />- Removing some words from the definitions since they are not discussed anywhere else in the <br />ordinance. <br />- Changing all references to the Building Official, City Administrator, and City Council to City <br />Engineer to streamline the process. <br />- Removing all fees and referring instead to the fee schedule. <br />- Adding an escrow to be collected to ensure erosion control measures are taken and the site is <br />properly restored. <br />- Removing the requirement that permit requests for more than 100 cubic yards must be <br />approved by the City Council. All other cities that were researched handled these permits at a <br />staff level. Very large projects such as a development would be brought to the City Council <br />anyway. <br />- Removed the second to last section referring to landfills in progress, which no longer pertains <br />to the City. <br /> <br />The new fees have been added to the fee schedule that will be amended at the meeting on March 13. <br />Staff feels that this streamlines the permit process and the erosion control escrow addition will aid in <br />making sure projects are complying with our NPDES permit. The City averages about one filling and <br />grading permit per year since it is so built out already. Redevelopments and new developments are <br />addressed as part of the planning review process so those do not require this type of permit. <br /> <br />STAFF RECOMMENDATION: <br />Staff recommends approval and adoption Ordinance 837, Amendments to Chapter 1501 - Filling, <br />Grading, and Excavating Operations, and approve publication of the attached summary ordinance. <br />Pursuant to Minnesota Statutes Section 412.191, in the case of a lengthy ordinance, a summary may be <br />published.
