CITY OF LITTLE CANADA <br />RAMSEY COUNTY <br />STATE OF MINNESOTA <br />ORDINANCE NO. 837 <br /> <br />AN ORDINANCE AMENDING CHAPTER 1501 OF THE LITTLE CANADA <br />MUNICIPAL CODE, FILLING, GRADING AND EXCAVATING OPERATIONS <br /> <br />The City Council of the City of Little Canada, Ramsey County, Minnesota does hereby ordain: <br /> <br />SECTION 1. The City Council of the City of Little Canada hereby amends Chapter 1501 of the <br />Little Canada Municipal Code by adding the underlined material and deleting the stricken <br />material as follows: <br /> <br />1501. FILLING, GRADING AND EXCAVATING OPERATIONS <br /> <br />1501.010. PERMITS REQUIRED. No person, firm, or corporation shall do any filling, <br />grading, or excavating without first having obtained a permit from the building official City <br />Engineer except for: <br /> <br />1. An excavation below finished grade for basements and footings of a building, <br />retaining wall, or other structure authorized by a valid building permit. <br /> <br />2. Cemetery graves. <br /> <br />3. Excavations for wells or utilities. <br /> <br />4. Mining quarrying, excavating, processing, stockpiling of rock, sand, gravel, <br />aggregate, or clay where established and provided for by law, provided such <br />operations do not affect adjacent or surrounding property. <br /> <br />5. Exploratory excavations under the directions of soil engineers. <br /> <br />6. All excavating and grading covered by an engineering escrow required by other <br />City Ordinances or agreements. <br /> <br />7. The following provided that the building official determines that there is no <br />potential or actual danger or detriment to public or private property and no <br />interference with natural drainage: <br /> <br />a. An excavation which is 2 feet or less in depth and does not create a slope <br />greater than 5 feet in height and 1 1/2 to 1 slope. <br /> <br />b. Fill 3 feet or less in depth not intended to support structures, which does
