Stat. § 469.068, subd. <br />1. An emergency, with respect to port authorities, also is defined as <br />“unforeseen circumstances or conditions that jeopardize human life or <br />property.” <br /> G. Emergency contracts with a city official <br />Minn. Stat. § 471.88, subd. <br />5. Generally, a city cannot contract with one of its officials. One of the <br />exceptions to this rule includes contracts not required to be let using the <br />competitive bidding process. Because the competitive bid process does not <br />apply in emergencies for certain contracts, this exception may allow a city <br />to contract with one of its officials in an emergency. <br /> The city must abide by the following procedure, whether an emergency or <br />not, to use this exception: <br /> <br /> <br />Minn. Stat. § 471.88, subd. <br />1. <br /> <br />• The interested officer should abstain from voting on the matter. <br />• The remaining council members must approve the contract by <br />unanimous vote. <br /> <br /> <br />Minn. Stat. § 471.89, subd. <br />2. <br />• Unless impracticable because of any emergency, the council must pass <br />a resolution setting out the essential facts, such as the nature of the <br />interested officer’s interest and the item or service to be provided, and <br />stating that the contract price is as low, or lower, than elsewhere. In <br />case of an emergency when the contract cannot be authorized in <br />advance, payment of the claims shall be authorized by a similar <br />resolution in which the facts of the emergency also are stated. <br />Minn. Stat. § 471.89, subd. <br />3. Before paying on these contracts, the interested officer must file an <br />affidavit with the clerk that contains the following information. <br /> • The name and office of the interested officer. <br />• An itemization of the commodity or services furnished. <br />• The contract price. <br />• The reasonable value. <br />• The officer’s interest in the contract. <br />• A statement indicating that to the best of the officer’s knowledge and <br />belief the contract price is as low as, or lower than, the price that could <br />be obtained from other sources. <br />LMC information memo, <br />Official Conflict of Interest. When the council considers the claim, the interested officer should not <br />vote on the matter. The remaining councilmembers must approve the claim <br />by unanimous vote.
