<br />how quickly Mr. Erdmanis can unload/dispose of his equipment and materials, plus providing space to <br />meet the needs of On-Site Sanitation. Mr. Erdmanis is unable to provide a definitive timeframe, but <br />suspects that he would occupy the outdoor storage area for 12-24 months of the proposed interim use <br />timeframe. <br /> <br />It has been previously mentioned, but the grandfathering rights once a change in use occurs (i.e. On- <br />Site Sanitation use of outdoor storage) would trigger compliance for the I-P District. That also <br />includes then the use of the site by Mr. Erdmanis. The grandfathering status does not remain as legal <br />non-conforming use on a portion of the site. The change in use impacts the property as a whole. <br />Additionally, our city code prohibits outdoor storage as a principal use of the property in all zoning <br />districts. <br /> <br />In considering an Interim Use Permit there are conditions that would need to be outlined in the text <br />amendment ordinance language. Those conditions warrant further discussion and specificity. The <br />applicant is seeking to be allowed up to 36 months to begin construction. A more accurate condition <br />city staff believes should cover the duration of project through construction given outdoor storage is <br />likely to remain on the property this entire time. Other conditions to cover in the ordinance language <br />would be user(s) of the outdoor storage area (i.e. On-Site Sanitation, Buck Blacktop, or other), outdoor <br />storage area allowed, requirement for outdoor storage license, and/or other conditions yet to be <br />determined. <br /> <br />Based on staff’s recommendation for denial of the variance request, the maximum outdoor storage area <br />allowed would be 6,250 square feet based on a 35,000 square foot building. City staff would <br />recommend the Interim Use Permit address specific conditions that outline how the timing of the <br />existing outdoor storage (i.e. Buck Blacktop), plus any new outdoor storage by On-Site Sanitation will <br />occur. This may be handled through a requirement for a Development Agreement, but city staff would <br />be hesitant to approve with the vagueness as proposed. Examples of scenarios for further discussion <br />are – <br /> Is the maximum outdoor storage allowed up to 6,250 square feet based during duration of <br />IUP? This scenario means the current user would likely need to be removed in its entirety <br />before On-Site Sanitation could occupy the site. <br /> Is there a condition of IUP language to allow a certain timeframe (up to 12-24 months) for <br />removal of Mr. Erdmanis’s belongings and On-Site Sanitation is then limited to no more than <br />6,250 square feet of outdoor storage during duration of IUP? This provides for both uses to <br />co-exist as the property is in transition. <br /> <br />City staff is seeking further direction from the Planning Commission on text amendment language <br />conditions and whether or not formal ordinance should be prepared.
