MINUTES <br />PLANNING COMMISSION <br />MAY 10, 2001 <br />for that portion of the garage facing the neighbor's property might be a <br />good solution. <br />There was discussion about increased run-off from the roof The Planner <br />noted that the property owner is required to provide for drainage, and <br />drainage cannot have an impact their ueighboi's property. <br />Keis asked about the existing slab on the Abraham property. Mrs. <br />Abraham replied that the existing slab would be removed and replaced <br />with a new one for the garage. <br />Duray stated that he did not feel the criteria for a hardship was met and <br />was concerned about the precedent that would be set. Duray suggested <br />that aone-car garage be constructed. <br />The City Planner pointed out that one criteria for a hardship is whether the <br />property can be put to a reasonable use. The Plam~er indicated that the <br />issue the Commission is struggling with is whether atwo-car garage is a <br />reasonable use or whether aone-car garage is a reasonable use. The <br />Planner indicated that the City has a lot of latitude in defning what a <br />reasonable use is for the community. <br />Carson felt that the entire neighborhood would be more valuable if the <br />homes had two car garages. <br />Roycraft recommended approval of the Variance from the Zoning Code <br />requirement of 10 foot minimum side yard setback allowing a new garage <br />with a 5 foot side yard setback at 2535 Stark Street as requested by <br />Tsgeroman Abraham subject to the overhang for the roof being minimized <br />and a hip roof being installed on the side of the garage facing the <br />neighbors, and based on the fact that there is a mix of setbacks in this <br />neighborhood which results in a 5 foot setback not being out of character <br />in this neighborhood, that the garage to be constructed is 19 feet, 6 inches <br />wide which is the smallest dimension possible for a standard two car <br />garage, based on the fact that prior to the Code being changed iu ] 979 5 <br />foot setbacks were allowed. <br />Motion seconded by Wojcik. <br />Motion carried 4 to 2. Duray and Keis voted against. <br />ADJOURN Carson recommended that the meeting be adjourned. <br />Motion seconded by Barraclough. <br />
