MINUTES <br />CTTY COUNCIL <br />JUNG 27, 2001 <br />*APPROVING THE VOUCFIF.RS <br />The foregoing resolution was duly seconded by Pahey. <br />Ayes (5) LaValle, Fahey, Scalze, Anderson, Montour. <br />Nays (0). Resolution declared adopted. <br />PURINA PARK Mr. Carl Helgeson, President of the Pitrina Park Homeowners Association <br /> <br />REQUEST FOR , <br />appeared before the City Council requesting that the City take over the <br />CITY TO TAKE ownership and maintenance of the five private cul-dc-sacs in Pitrina Park. <br />OVER PRIVA'T`E Helgeson pointed out that the property owners in Pitrina Park pay high <br />STREETS property taxes and are not getting the same services that other property owners <br /> receive. Helgeson requested that based on the issue of fairness, the City take <br /> over the maintenance of these cul-de-sacs. <br />Fahey pointed out that the difficulty is that the cul-de-sacs were not <br />constructed to City standards with regard to both construction and amount of <br />right-of way. Fahey also noted that the setbacks of the townhomes from the <br />cul-de-sacs would not meet the City's minimum setback requirements. These <br />issues were discussed with the developer at the time Pitrina Park was proposed, <br />and the developer requested the cul-de-sacs be private. Fahey pointed out that <br />the Council discussed with the developer in no uncertain terms that these cul- <br />de-sacs would not be City streets and would remain the responsibility of the <br />developer or townhome association. Fahey stated that he did not feel it was <br />unfair not to accept the cul-de-sacs as public streets. <br />Helgeson reported that not all the Pitrina Park property owners knew the cu]- <br />de-sacs were private at the time they purchased their townhome. Helgeson <br />indicated that he did some measuring of some other streets in town and found <br />cul-de-sac areas to be smaller than those iu Pitrina Park, specifically that of <br />Savage Lane. <br />Scalze pointed out that the Savage Lane cul-de-sac may be narrower given that <br />the freeway went in after the street ah~eady existed. Scalze also pointed out <br />that right-of--way is not the same as pavement width. h~ the case of Pitrina <br />Park, there is inadequate right-of--way. <br />Helgeson pointed out that the City never asked the Pitrina Park homeowners if <br />they wanted the cul-de-sacs as private. The issue was between the City and the <br />developer. Helgeson pointed out that the developer wanted private cul-de-sacs <br />in order to maximize his space, and the City wanted to maximize property <br />taxes. <br />l0 <br />
