MINUT:GS <br />CITY COUNCIL <br />AUGUST 8, 2001 <br />CHAMBER OE The Council reviewed the invoice for renewal of membership dues for <br />COMMERCE the Chamber of Commerce. It was noted that the Suburban and Saint <br />MEMBERSI3II' Paul Area Chambers of Commerce have merged. <br />DUES <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOI_iJTION NO. 2001-8-171-APPROVING THE PAYMENT OF <br />2001/2002 MEMBERSHIP DUES WITH THE SAINT PAUL. AREA <br />CHAMBER OF COMMERCE IN THE AMOUNT OF $294.00 <br />The foregoing resolution was duly seconded by Montour. <br />Ayes (4) Scalze, Montour, Fahey, LaValle. <br />Nays (1) Anderson. Resolution declared adopted. <br />RELOCATION Council reviewed the Public Works Director's August 8, 2001 report <br />OF POWER relative to Xcel Energy's request for payment of $4,392.00 to relocate <br />POLE - a power pole as part of the Little Canada Road/McMenemy Street <br />LITTLE CANADA/ parking lot reconstruction. It was noted that the current location of the <br />NicMENEMY pole conflicts with the McMenemy entrance to the parking lot. <br />PARKING LOT <br />Fahey indicated his opposition to paying for this work, noting that the parking <br />lot is a public facility and his expectation that Xcel Energy should relocate this <br />pole at no cost. The Counci] agreed with this position, and it was the <br />consensus of the Council that should Xcel )/nergy insist on payment, the City <br />would pay the cost under protest in order to not hold up completion of the <br />parking lot project. However, the City would then pwsue recovery of those <br />COSIS. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESO7. U!'ION NO. 2001-8-172 -INSTRUCTING THE CITY <br />ADMIMS'TRA'TOR .4ND/OR PUBLIC WORKS DIRECTOR TO INI'ORM <br />a'CEL ENERGY THAT TI3E CITY'S POSITION 1S THAT GI vEN THF_ <br />PUBLIC NATURE OF THE LITTLE CANAD,9/McMENEMY PARKING <br />T OT PROJECT, THE POWER P07 E SHOULD BE RELOCATED AT NO <br />COST AND AUTFIORIZING THE CITYADMINISTRATOR TO MAKE <br />PAYMENT FOR TLIE WORK SHOULD A'CEL ENERGY INSIST WITH <br />XCEl, ENERGY TO BF, INFORMED THAT TFIE PAYMENT IS MADE <br />UNDER PROTEST AND THE CITY WII_I_ TAKE AC770N TO RECO vER <br />THE COS7S AS APP72UPRIATE <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, LaValle, Montour, Scalze, Anderson. <br />Nays (0). ,Resolution declared adopted. <br />
