MINUTES OF THE SPECIAL MEETING <br />CITY COUNCIL <br />LITTLE CANADA, MINNESOTA <br />Pw'suant to due call and notice thereof a special meeting of the City Council of <br />Little Canada, Minnesota was held on the 29th day of August, 2001 in the <br />Council Chambers of the City Center located at 515 Little Canada Road in said <br />City. <br />ADGUST 29, 2001 <br />Council Member Tim LaValle called the meeting to order at 6:30 p. m. and the <br />following members of the City Council were present at roll call: <br />CITY COUNCIL: <br />Council Member <br />Council Member <br />Council Member <br />Mr. Jim LaValle <br />Mr. Matt Anderson <br />Mr. Rick Montour <br />ABSENT <br />ALSO PRESENT: <br />Mayor <br />Council Member <br />City Administrator <br />Deputy Clerk <br />Mr. Michael I. Hanson <br />Ms. Kathy Glanzer <br />COUNTRY With regard to provisions in the development agreement with Country <br />DRIVE Drive Investors, LLC, the City Administrator reviewed the research <br />INVESTORS, prepared by statTrelative to Condit Street right-of way. He noted that <br />LLC - there is 46.5 feet ofright-of--way for Condit Street adjacent to the Zoch <br />DEVELOPMENT property. At the time that Yorkton Ridge was platted, Condit consisted <br />AGREEMENT of 33 feet ofright-of--way (I6.5 feet on either side of the centerline). When <br />Yorkton Ridge was platted, an additional 13.5 feet was granted by the Zoch's. <br />The City Administrator noted that Mr. and Mrs. Zoch signed the plat that <br />included the dedication of this additional riglu-of way. The Administrator <br />noted that Mr. and Mrs. Zoch have asked that 5 feet of this right-of--way be <br />returned to them. The City Administrator recommended against this. <br />The City Administrator reported that Yhere is 33 feet ofright-of--way for Condit <br />adjacent to the Bougie property. The City Administrator recommended that at <br />the time the Bougie property develops in the future, the City obtain additional <br />right-of--way for Condit Street. Lie noted that obtaining the additional right-of <br />way from the east side of the street would cause a jog in the right-of--way and <br />would also result in the City having to negotiate for right-of--way from <br />approximately five additional property owners. Most of the property on the <br />east side of Condit Street is developed, therefore, taking additional right-of- <br />way would impact existing berms and parking lots. <br />
