MINUTES <br />CITY COUNCIL <br />JANUARY 26, 2000 <br />CUP -LITTLE It was noted that the Planning Commission tabled action on the <br />CANADA ROAD/ Conditional Use Permit and Variance as requested by Northeast <br />McMENEMY Residence for a group home facility at Little Canada Road and <br />ROAD - McMenemy Road until their February meeting. <br />NORTHEAST <br />RESIDENCE Mr. Morelan introduced the following resolution and moved its adoption: <br />RESOLUTION NO.2000-1-20 -TABLING ACTION ON THE <br />CONDITIONAL USE PERMIT AND VARIANCE AS REQUESTED <br />BYNORTHEAST RESIDENCE, INC. PENDING A <br />RECOMMENDATION FROM THE PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Morelan, Scalze, Fahey, Pedersen, LaValle. <br />Nays (0). Resolution declared adopted. <br />REZONING & Fahey opened the public hearing to consider the request to rezone <br />CUP -120 WEST 120 West County Road C from General Business (B-3) to Comprehen- <br />COUNTY RD. C - sive Business District (B-4) as well as an amendment to an existing <br />TOM Conditional Use Permit increasing the size of the existing vehicle sales <br />TUBBESING lot as requested by the property owner Tom Tubbesing. The Planning <br /> Commission has recommended approval subject to compliance with the <br /> recommendations of the Planning Commission. <br />Scalze asked what zoning the Comprehensive Plan has designated for this <br />property. The City Planner pointed out that the Comp Plan does not <br />designate a specific zoning, but rather use. The use designated for this <br />area gives the Council the flexibility to rezone to the B-4 District if it so <br />chooses. <br />Tom Tubbesing reported that he has reviewed the recommendations of the <br />Public Works Director and has no problem complying with them. He <br />pointed out that he has an easement for access via the alleyway on the east <br />side of his property. Tubbesing also reported that his property currently <br />drains from north to south. With the grading and blacktop resurfacing that <br />is planned for the site, run-off will occur toward County Road C lessening <br />the run-off to the existing storm drain. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by LaValle, seconded by Pedersen, the public hearing was <br />closed. <br />10 <br />
