MINUTES <br />CITY COUNCIL <br />JANUARY 26, 2000 <br />some of the cities have sent out letters to their liquor establishments <br />informing them that compliance checking would begin and informing <br />them of the consequences that would result from failures. <br />Britt reported that if the City agrees to participate, the next step would be <br />to set up a civil penalty for those establishments that have failures. <br />LaValle asked if the City had the luxury of not imposing criminal <br />penalties for failures. The City Attorney reported that it would be the <br />police officer's discretion whether to write a ticket or not. However, if a <br />ticket is written, the violation would be criminally prosecuted. The City <br />does not have the authority to merely impose an administrative penalty. <br />Morelan asked if the results of the study will be used by the U of M in an <br />effort to make compliance checking mandatory. Britt replied that the U of <br />M would not lead such a lobbying effort. However, there are groups out <br />there that are waiting for the results of this study and will likely use the <br />results in that manner. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000-1-30 -AUTHORIZING THE CITY'S <br />PARTICIPATION IN THE UNIVERSITY OF MINNESOTA'S TWD- <br />YEAR STUDYON THE EFFECTS OF ALCOHOL COMPLIANCE <br />TESTING BYAGREEING THAT THE RAMSEY COUNTY <br />SHERIFF'S DEPARTMENT SHOULD CONDUCT TWO ALCOHOL <br />COMPLIANCE CHECKS PER LIQUOR ESTABLISHMENT PER <br />YEAR <br />The foregoing resolution was duly seconded by Scalze. <br />Ayes (5) Fahey, Scalze, Morelan, Pedersen, LaValle. <br />Nays (0).
