MINUTES <br />CITY COUNCIL <br />JANUARY 26, 2000 <br />LEE ROSSOW by Mr. Lee Rossow. It was noted that the Planning Commission has <br />recommended approval of the CUP subject to compliance with the <br />recommendations of the Zoning Administrator. <br />The Zoning Administrator reported that this matter was tabled at the <br />December 15`x' Council meeting pending clarification of where the lot <br />lines were located in relation to the road surface. The Administrator <br />reported that in this particular location Spruce Street is centered within the <br />road right-of--way. Mr. Rossow has agreed to move all required parking <br />spaces out of the public right-of--way. However, the planters are in the <br />right-of--way. <br />Morelan indicated that he did not have a problem with the landscape <br />structures remaining in the right-of--way, but he did have a problem <br />considering these structures to be the green spaces that is required by <br />ordinance. Morelan stated that the structures are islands in a sea of <br />blacktop. He also felt that the City should enforce its requirement for a <br />five foot green area. <br />Scalze felt there should be no impediment in the public right-of--way other <br />than grass as provided for in the Zoning Ordinance. Scalze indicated that <br />anything other than grass would require a variance. <br />Pedersen pointed out that Mr. Rossow's rational was that given the nature <br />of his business, a grassy green area would be driven over and the grass <br />could not be maintained. <br />Scalze commented that the Zoning Ordinance requires grass and that is <br />what should be maintained. Scalze felt that if planters are going to be <br />allowed on the right-of--way, then the Code should be amended to allow it. <br />Scalze pointed out that the planters are approximately three feet from the <br />street surface. If control measures are needed for Mr. Rossow's buses, <br />they should not be on the public right-of--way. <br />Rossow reported that they have tried several different things to control <br />their bus traffic in and out of the site. The only thing that will work are <br />controls that are above ground level and fairly rigid. Rossow reported that <br />he has tried grass and that does not last. <br />Scalze stated that the planters are fine, but they should not be in the public <br />right-of--way. Fahey stated that he did not have a problem with the <br />structures in the right-of--way. Morelan agreed that the planters are fine, <br />but the City should impose its requirement for afive-foot green area. <br />
