MINUTES <br />CITY COUNCIL <br />JULY 2G, 2000 <br />VARIANCE - Mayor Fahey opened the Public Hearing to consider the application <br />3179 SPRUCE for a Variance from the side yard setback requirement of fifteen (15) <br />STREET - feet for 3179 Spruce Street as requested by Mr. Don Valento. It was <br />VALENTO noted that the City Planner and the Planning Commission have <br /> recommended approval of the variance. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Fahey, seconded by Morelan, the public hearing was <br />closed. <br />Fahey suggested approval of the variance subject to compliance with the <br />recommendations of the City Planner and the Planning Commission. He <br />noted that the Planning Commission felt that a hardship existed to warrant <br />granting the variance based on the precedent that has been set with <br />variances granted on the Belland and Stanke properties. It was noted that <br />all three properties abut railroad right-of--way. <br />LaValle suggested that any approval also be subject to compliance with <br />code issues identified at the time the Conditional Use Permit was <br />processed for this property. <br />The Code Enforcement Officer reported that the property owner had been <br />given a deadline of August l s` for compliance with code issues. The City <br />Administrator reported that there are several outstanding code issues at <br />3179 Spruce Street. He noted that it would be difficult at this time to <br />achieve compliance with the August ls` deadline. <br />Don Valento, property owner, indicated that this past June he had to <br />replace the water service to his property with copper line as well as <br />relocate the shut-off. He also indicated that he has been working on the <br />issue of blacktopping his property with the adjacent property owner. He <br />noted that his property and Jacobsen Excavating share a driveway <br />entrance, therefore, blacktopping needs to be a coordinated effort. <br />Valento reported that he has not yet completed screening of the trash <br />enclosure. Jacobsen Excavating will construct the fencing that is required. <br />Valento indicated that he would not be able to make the August ls` <br />deadline for code compliance issues, but he would be able to be in <br />compliance by September lz`. Valento indicated that Frattalone Paving <br />will be doing the blacktop work at 3176 Spruce Street in about two weeks <br />and he will have 3179 Spruce done immediately after that. <br />
