MINUTES <br />CITY COUNCIL <br />AUGUST 23, 2000 <br />CONDITIONAL Mayor Fahey opened the public hearing to consider the applications for <br />USE PERMIT & Variance from the side yard setback requirement of fifteen (15) feet and <br />VARIANCE - Conditional Use Permit allowing an accessory building forward of the <br />3179 SPRUCE rear building line of the principle structure at 3179 Spruce Street as <br />STREET - requested by Don Valento. Fahey noted that the Planning Commission <br />DON VALENTO has recommended approval ofboth the Variance and the CUP subject to <br /> compliance with the recommendations of the City Planner. <br />Fahey noted that Mr. Valento has submitted information relative to the <br />trusses in his building. This information has been reviewed by the <br />Building Official; however, no on-site inspection was done. Fahey asked <br />if it was Mr. Valento's representation that the type of roof trusses depicted <br />in the diagram are the same as in the building at 3179 Spruce Street. Mr. <br />Valento replied that they were. He indicated that he is a civil engineer and <br />he made the diagram of the roof twsses that he submitted to an engineer <br />for analysis. The engineer analyzed the diagram and determined that the <br />roof trusses are over-stressed. <br />Fahey asked if the accessory building was needed as strictly an accessory <br />use to the principle structure. Valento replied that the accessory building <br />would be used by the tenant of the principle building. <br />Fahey asked what business was occupying the fenced in area behind the <br />building. Valento replied that that area is occupied by his construction <br />business. <br />Scalze pointed out the letter from the St. Paul Water Utility requesting that <br />a fence be installed at the 35-foot easement line. Mr. Valento pointed out <br />that there is currently a fence at the back of the property, but it would have <br />to be moved in order to comply with the Water Utility's request for <br />fencing the 35-foot easement area. Mr. Valento indicated that he would be <br />discussing this issue with the Water Utility. He noted that he owns the <br />property and has an issue with being required to fence the easement area <br />in order to prevent him from going on his own land. Mr. Valento reported <br />that storage has encroached into that 35-foot easement area, and he would <br />be removing the materials stored on this property. He will propose to the <br />Water Utility that he install concrete curb stops on the 35 foot line and <br />keep this easement area surfaced in grass. <br />Scalze noted that the Water Utility is requesting that the City require the <br />fence as part of any approvals it might grant. Mr. Valento felt that the <br />issues was between him and the Water Utility, and indicated that he would <br />be discussing it with them. Morelan agreed with Mr. Valento that this <br />issue was between Mr. Valento and the Water Utility. <br />
