It is intended to summarize the Ciiy's review or the questions raised r egarcinc
the installation or a concrete patio by Mr. Kueppers on his nrope!ty at 2420 Sunrise Dive
adjacent to property owned by Mr. Houie at 2430 Sunrise Drive. It is ine understancinc
of Ciry Starthat Mr. Houle has obie~ ed to the location oithe patio based on anro conc~ms:
one concern is over the drainage from that improvement, and a Bernd isa c:aim mat u-e
location of the patio violates the City's Zoning Ordinance. A third odiecdon was ~ ~isec
reaardino the use or the space for storage. It is Ciry Stall's opinion :hat the Z~rin_
Ordinance precludes any outdoor storage in at least the ten Tee*. adjacent to the proce:-r
line. Mr. Kueooers was informed or this issue, and has agreed to remove any such etc.. ice
from the area.
With regard to the drainage issue, the City believes this to be a marten between the two
private property owners, and not one in which the City has any involvement. ,~s dis.:~ss
with both parties, improvements such as poured concrete on private orope.~ty typiraily cc
not require any City permit or review. The City makes no representations as to the proper
instailaiion of the pano Tor any purpose.
With regard to the Zoning Ordinance, start has indicated that pouring concre*.e has rot
been interpreted to be subject to the setbacks or setback exclusions. IU1y interDre~ticn c;
Secdon 903.030. C. has been that patios are not within `she meanine or any of those
improvemenis mentioned in this secdon. Moreover, the City Stmt is unaware ci any
previous enforcement of a se~ack requirement for similar improvements.
5 i 7 S VVAY=?.-.> eOUL ~/aRO.
R`~CNE d'. _ 595-?030 =A
?4RK. `AINN ESC-.~ = - - ~ '~
Page 51 ~„ _ _ V ,~,
