NORTHWEST ASSOCIATED CONSULTANTS <br />I N C C O M M U N I T Y PLANNING - D E S I G N - MARKET R E S E A R C H <br />MEMORANDUM <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: January 12, 2000 <br />RE: Little Canada -Setback Encroachments <br />FILE N0: 758.10 - 00.01 <br />As discussed previously, staff has been addressing the issue of allowable encroachments <br />into side yards. In one case, a dispute arose between neighbors as to a concrete pad <br />which one property owner constructed adjacent to the common property line. The <br />neighboring property owner contended that the City's zoning ordinance prohibits such an <br />improvement in the side yard. City staff interpreted the ordinance differently, but has <br />prepared the attached amendment to help clarify the language in this area. <br />One of the issues which was raised in this situation is the definitions of the improvements <br />listed in the ordinance. A second issue was the fact that the City does not issue building <br />permits for some of the improvements, resulting in a condition where a property owner <br />might unknowingly establish a certain improvement encroaching into a side yard setback <br />without the need to contact City Hall, but the neighbor would then ask City Hall to enforce <br />its ordinance.
