MINUTES <br />PLANNING COMMISSION <br />JULY 13, 2000 <br />Keis recommended that the application for CUP allowing total garage <br />space of approximately 1,300 square feet for 743 East County Road B-2 as <br />requested by Mr. and Mrs. Tacheny be tabled until the August 10, 2000 <br />Planning Commission meeting. <br />Motion seconded by Carson. <br />Motion carried 5 - 0. <br />VARIANCE - Mr. Remi Ducharme appeared before the Commission requesting approval <br />3179 SPRUCE of a Variance from the side yard setback requirement of fifteen (15) feet <br />STREET - for 3179 Spruce Street. Ducharme pointed out that he had a storage trailer <br />VALENTO on the property which he has now removed. However, he needs to <br />construct some permanent storage space to replace the trailer. Ducharme <br />is proposing a 26-foot by 40-foot garage next to the building. Ducharme <br />noted that the diagram had indicated the garage would be setback 5 feet <br />from the property line, and he has room to set it 8.3 feet from the property <br />line. <br />Ducharme indicated that he will be paving the property soon. He has been <br />waiting until Jacobsen Excavating is ready to pave given their shared <br />driveway situation. The paving should be completed by the end of July. <br />Keis. pointed out that there has been a precedent set for a variance of this <br />type. The question is the spacing between the existing garage and the <br />building. The City Planner has pointed out that there is a six-foot building <br />separation requirement. <br />The Deputy Clerk noted that she discussed this issue with Mr. Valento <br />when he made application. Mr. Valento indicated that the 6-foot <br />requirement could be decreased if fire-rated walls were installed <br />separating the two structures. The Deputy Clerk noted, however, that she <br />did not verify this with the Building Inspector. <br />Mr. Ducharme noted that to get a 6-foot separation, NSP would have to <br />move a power pole. However, he felt this could be done and he would be <br />willing to pay for relocating the power pole. <br />Keis recommended approval of the Variance from the side yard setback <br />requirement of fifteen (1 S) feet for 3179 Spruce Street given the existing <br />precedent for this type of variance, and allowing placement of the <br />structure up to five feet from the property line, if necessary, based on <br />building code requirements. <br />
