N <br />INC <br />MEMORANDUM <br />TO: <br />FROM:. <br />DATE: <br />RE: <br />FILE NO <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING <br />Little Canada Planning Commission <br />Stephen Grittman <br />July 10, 2000 <br />DESIGN - MARKET RESEARCH <br />Little Canada -Tacheny Garage Conditional Use Permit <br />758.09 - 00.19 <br />Background/Analysis <br />Dan and Wendy Tacheny have applied for a Conditional Use Permit to construct a second <br />garage building on their property at 743 East County Road B2. This property is one offour <br />lots served by a long driveway easement from County Road. B2 to the south shoreline of <br />Gervais Lake. The proposed garage is a detached structure of 616 square feet. With the <br />attached garage, the property would exceed the 1,000 square foot threshold for total <br />garage building size, triggering the CUP requirement with a total of 1,252 square feet. <br />Conditional Use Permits for oversized garage space (between 1,000 and 1,500 square <br />feet). have been considered for properties where. the size of the property would allow for <br />the additional space without appearing to be crowded; and where the City is confident that <br />the building will be' utilized for residential purposes only, as opposed to commercial <br />building use. The lot in question is about three quarters of an acre in size. The applicant <br />indicates that the building would be used for storage of residential recreational equipment, <br />and is not intended for any commercial purpose. <br />The primary issue in this case is the location of the proposed- building. The new garage <br />is to be located ten feet from the driveway property line. between the driveway and the <br />house. Because the property fronts on a driveway easement, rather than a public street, <br />its technical street frontage is'several hundred feet away on County Road B2. This area <br />would be treated as the front yard, however, and should require a setback minimum of <br />thirty feet from the driveway easement. It appears that the building could be placed in the <br />side yard, or it could be attached to the attached garage without a setback issue.
