Setbacks <br />Front yard 40 feet from the property line <br />Side yards Not less than fifteen (15) feet on any one side, nor less than <br />forty (40) feet on the side yard abutting a street. <br />Rear yard 20 feet from rear boundary line <br />Proposed Site Plan Changes <br />The applicants are requesting two major changes to the previously approved site plan. The <br />first is to allow the fence for the outdoor storage area to run parallel to the building and not <br />to the property line. The previously approved site plan depicts the fence for the storage <br />area set back 40 feet from the property line and running parallel to it. The applicants are <br />requesting that the fence be situated parallel with the building and setback from forty feet <br />at the northwest corner to 20 feet at the southwest corner. <br />The second requested change is to install two entry curb cuts at 32 feet in width rather <br />than one at 24 feet in width. <br />Analysis <br />Due to the irregular lot shape caused by the narrow angle of the western property line, and <br />the orientation of the building on the lot, the previously approved site plan for the <br />Conditional Use Permit makes for very difficult large truck maneuverability. The amended <br />site plan as proposed allows for much safer and easier maneuverability of large trucks <br />entering and exiting the property and backing up to the storage area. <br />The purpose of placing the fence forty feet back from the property line at its entire length <br />was to insure that no outdoor storage would occur within the 40 foot setback requirement <br />for accessory storage. It is not, however, an ordinance requirement that such a setback <br />exist. Fences for all properties along the northern side of Ryan Drive with similar <br />Conditional Use Permits have screening fences immediately on property lines due to lot <br />irregularity. Like these properties, it would simply become an understanding that if outdoor <br />storage occurred within the required setback area, citation for City Code violation would <br />occur. <br />The fence and landscaping around the storage area at this property have already been <br />developed as proposed in the amended site plan. It is very aesthetically pleasing, and <br />compatible with the surrounding properties. The storage area is retained below the <br />landscaped grade by about 4 feet and is well screened with both spruce trees and a <br />slatted fence. <br />The amended site plan as proposed has been approved by the city engineer. <br />Page 4 <br />
