It is based on Bumsville's model developed in conjunction with the Minnesota Multi-Family Housing Association. I have attempted to modify it to our situation based on past comments by the City Council and in meetings we have held with representatives of some of local apartment complexes. A copy is currently being review by the City Attorney and he will be present at Wednesday's workshop. In this draft, I have used highlighting to indicate the following: RED -revisions to the previous draft GREEN -questions/issues that need to be addressed or clarified ORANGE -error in model that has omitted language Some of the key issues we need to discuss are as follow: / Inclusion of Single and Two Family properties. Initially, we had not proposed doing this. However, with the increasing conversion of single family homes to rental properties and some of the issues that have resulted, it may be a good idea to address those properties at this time. Many of our neighboring cities have focuses specifically on this issue. / Penalties for Violations / Inspection Documentation (HUD Inspections versus City Conducted Inspections) / Inspections of Individual Units, subject to consent / Penalties - by Unit or Complex / License Fees -See samples of Rental License Fees Attached / Establishment of a Property Maintenance Code (See Burnsville's Attached) / Related to the use of a Property Maintenance Code is a recent Supreme Court ruling involving the City of Morns. At this time, I'm not clear as to what role this code can play in a rental housing ordinance. I have asked the City Attorney to research this issue and report to us at Wednesday's workshop. The League of Minnesota Cities is also considering a legislative policy that may help to clarify this issue. / STAR Program requirements / Establishment of Administrative Fines (noted as civil fines in ordinance)
