It is based on Bumsville's model developed <br />in conjunction with the Minnesota Multi-Family Housing Association. I have attempted to modify it to <br />our situation based on past comments by the City Council and in meetings we have held with <br />representatives of some of local apartment complexes. A copy is currently being review by the City <br />Attorney and he will be present at Wednesday's workshop. <br />In this draft, I have used highlighting to indicate the following: <br />RED -revisions to the previous draft <br />GREEN -questions/issues that need to be addressed or clarified <br />ORANGE -error in model that has omitted language <br />Some of the key issues we need to discuss are as follow: <br />/ Inclusion of Single and Two Family properties. Initially, we had not proposed doing this. <br />However, with the increasing conversion of single family homes to rental properties and some of <br />the issues that have resulted, it may be a good idea to address those properties at this time. Many <br />of our neighboring cities have focuses specifically on this issue. <br />/ Penalties for Violations <br />/ Inspection Documentation (HUD Inspections versus City Conducted Inspections) <br />/ Inspections of Individual Units, subject to consent <br />/ Penalties - by Unit or Complex <br />/ License Fees -See samples of Rental License Fees Attached <br />/ Establishment of a Property Maintenance Code (See Burnsville's Attached) <br />/ Related to the use of a Property Maintenance Code is a recent Supreme Court ruling involving <br />the City of Morns. At this time, I'm not clear as to what role this code can play in a rental <br />housing ordinance. I have asked the City Attorney to research this issue and report to us at <br />Wednesday's workshop. The League of Minnesota Cities is also considering a legislative policy <br />that may help to clarify this issue. <br />/ STAR Program requirements <br />/ Establishment of Administrative Fines (noted as civil fines in ordinance) <br />
