Min. Reg, Meeting Dec 18 1972 Cont, Maintenance Mr, De Bace, WATER MAIN IMP, Mr. Johnson, one of the owners of the Johnsons Lake St, 73.5 Bros. tJell Co. Located at 2750 Noel Dxive9 approcahed the Noel Dr. 73-3 Council with a petition from residents on Noel Dr9 against the proposed water main improvement on Noel Dr. As it appears there are as many for the Imp- rovement as well as against the improvement. Mr, De Bace stated that he will check the petition with Mr, Gotwald and he also stated he will check the matter with the residents on the block, Since no action was taken on the matter, the improvement remain tabled until the next regular meeting, There was some discussion concerning the essence of a petition. It has been stated that it takes 35 °/, in frontage of real propexty abutting on a street to initiate the proceeding for an improvement hearing. The question concerning the council9is a petition to be based on the num- ber of signatures or the amount of footage proposed to be assed in the improvement, The engineer pointed out that the assessment for improvement is against the property not persons, The assessemnt is based on footage, and the petition is based on frontage, The attorney pointed that9if a person owns 90% of the front footage proposed to be assessed on a improvement and to other persons own 10 °(, of the prop erty proposed to be assessed, the person with the 90 % may have moxe priority, Mr, De Bace informed the Council that majority of the residence on Lake St. are for the proposed improvement, Upon the motion of Mr, De Bace and seconded by Mr. Rudy, it was resolved theta t4hereast Pursuant to a Council Resolution adopted on the 18th day of Sept 19729 whereby the Council fixed a date for a hearing on the following proposed improvem- ents, ( watermain) Imp, 73- 1 Eli Rd, Imp, 73- 2 Racine Dr, Imp, 73- 3 Noel Dr, Imp, 73. 4 Austraiian Imp, 73- 5 Lake St, page 2
