<br />FINDINGS <br /> <br />Zoning: <br />The property is within the R-1, Single Family Residential District. City Code Section 903.020 <br />(D)(4), General Provisions allows for detached garages that exceed 1,000 square feet by <br />Conditional Use Permit. <br /> <br />What is a Conditional Use Permit? <br />CUP is an abbreviation for Conditional Use Permit. A Conditional Use Permit is a use that is <br />permitted in a zoning district under the Zoning Ordinance, if certain conditions, designated by the <br />City Council, Planning Commission, or specified in the Zoning District, are met. <br /> <br />City Code Section 903.020 (D)(4): <br />No accessory building or detached garage for a single-family dwelling shall occupy more than <br />twenty-five (25) percent of the area of the rear yard. The total floor area of a garage and other <br />accessory buildings for a single family detached dwelling shall not exceed one thousand (1,000) <br />square feet of floor area per lot, except by conditional use permit pursuant to Section 921 of this <br />Ordinance. In no instance shall the total floor area of a garage and an accessory building for a <br />single-family dwelling exceed one thousand five hundred (1,500) square feet. No Conditional Use <br />Permit shall be issued for detached accessory building or garage area of more than one thousand <br />(1,000) square feet in which the accessory building and/or garage exceeds ten (10) percent of the <br />rear yard. <br /> <br />The applicant proposes to remove the only existing 864 square foot detached garage and replace <br />it with a new detached 1,400 square foot garage in a similar footprint on the property. <br /> <br />Setbacks: <br />The Ordinance requires over-sized accessory structures to be set back not less than 10 feet from <br />side lot lines and 30 feet from the rear lot line. The proposed detached garage addition is located <br />in alignment with the existing principal structure on south side of the property. The site plan <br />submitted shows a setback of 10 feet on the side (south) lot line and far greater than 30 feet from <br />the rear (east). Applicable setback requirements have been satisfied. <br /> <br />Lot Coverage: <br />According to the Ordinance, no Conditional Use Permit shall be issued for detached accessory <br />building or garage area of more than 1,000 square feet in which the two combined exceeds 10 <br />percent of the rear yard. The proposal is for detached garage space and the applicant does not <br />have any other accessory structures in the rear yard. The proposed garage complies with this <br />provision as it would total approximately 8% of the rear yard. <br /> <br />Accessory Building Area: <br />The total garage and accessory building space upon a property may not exceed 1,500 square feet. <br />The proposed total attached garage area will be up to 1,400 square feet. The primary issue with <br />most oversized garages relates to the potential for over-crowding on the lot. As designed, the <br />addition will be located to the south of the principal structure. This detached garage will continue <br />to be the primary garage on the property, the principal structure does not have a garage attached.
