RESOLUTION <br />FINDING THE EXISTENCE OF A PUBLIC NUISANCE AT 990 COUNTY <br />ROAD D AND ORDERING THE ABATEMENT OF SAME <br />WHEREAS, the City of Little Canada Code Enforcement Officer responded to an <br />anonymous complaint regarding 990 County Road D within the City of Little Canada; <br />and <br />WHEREAS, upon inspection of the property a nuisance code violation is present and <br />jeopardizes the health, safety, and comfort of the property at 990 County Road D, and <br />neighboring properties, and <br />WHEREAS, on August 1, 2008 a notice was sent certified mail and posted on the <br />property to the owner delineating the nature of said violation, declaring the property in <br />question a public nuisance, and demanding correction of same by August 12, 2008; and <br />WHEREAS, no corrections were made by the owner by August 12, 2008; and <br />WHEREAS, the continued existence of this violation poses a continued health, safety, <br />and comfort hazard to all of the residents and neighboring residents of 990 County Road <br />D; <br />NOW, THEREFORE BE IT RESOLVED THAT the City of Little Canada hereby <br />declares the existence of a public nuisance at 990 County Road D and orders the <br />nuisance abated based upon the following actions: <br />1. The cutting and trimming of the grass around the entire property. Given the <br />current length of the grass, bagging and proper disposal will be required. <br />It is further ordered that City Staff shall contract for the necessary cleanup and when <br />completed, assess the costs plus administrative fees against the property pursuant to Little <br />Canada City Code, Chapter 301.080. <br />Adopted this 13th day of August 2008. <br />BY: <br />William Blesener, Mayor <br />ATTEST: <br />Joel R.
