916. FP", FLOODPLAIN DISTRICT <br />916.010. PURPOSE. The intent of this Section is to provide for the protection and <br />preservation of water channels and those portions of the adjoining floodplains which are <br />reasonably required to carry and discharge a regional flood and are subject to inundation by <br />regional floods. (Regional flood shall be defined according to standards established by the <br />Minnesota Department of Natural Resources and illustrated on the Little Canada Flood Insurance <br />Rate Maps (FIRM) effective November 3, 1982.) It is the intent of this district to be applied to <br />those areas which if left unrestricted, could result in loss of life and property, health and safety <br />hazards, disruption of commerce, utilities and governmental services, extraordinary public <br />expenditures for floodplain protection and relief and impairment of the tax base, all of which <br />adversely affect the public health, safety and general welfare. This district is furthermore created <br />and applied in compliance with requirements of Minnesota Statutes, Chapters 103F and 462, as <br />amended. In addition, Minnesota Regulations N.R. 85, as may be amended, shall be consulted in <br />administering and applying this district. <br />916.020. WARNING AND DISCLAIMER OF LIABILITY. This Section does not <br />apply that areas outside the "FP", Floodptain District boundaries or land uses allowed within this <br />district will be free from flooding or flood damages. This Section shall not create liability on the <br />part of the City of Little Canada or any officer or employee thereof for any flood damages which <br />result from reliance on this Ordinance or any administrative decision lawfully made thereunder. <br />916.030. DISTRICT APPLICATION. The "FP", Floodptain District shall be applied to <br />and superimposed upon all districts as existing or amended by the text and map of this <br />Ordinance. The regulations and requirements imposed by the "FP", Floodptain District shall be <br />in addition to those established by other districts of this Ordinance. The "FP", Floodptain District <br />shall be established based upon the specific information contained in the Flood Boundary, <br />Floodway and Flood Insurance Rate Maps (dated November 3, 1982) and the Flood Insurance <br />Study for the City of Little Canada (dated May 3, 1982). All aforementioned official maps and <br />documents are hereby adopted by reference and declared to be an integral part of this Ordinance. <br />A. Regulatory Flood Protection Elevation. The Regulatory Flood Protection Elevation shall <br />be an elevation no lower than one (I) foot above the elevation of the regional flood plus <br />any increases in flood elevation caused by encroachments on the flood plain that result <br />from designation of a floodway. B. Interpretation: <br />1. In their interpretation and application, the provisions of this Ordinance shall be <br />held to be minimum requirements and shall be liberally construed in favor of the <br />Governing Body and shall not be deemed a limitation or repeal of any other <br />powers granted by State Statutes. <br />2. Abrogation and Greater Restrictions: It is not intended by this Ordinance to <br />repeal, abrogate, or impair any existing easements, covenants, or deed restrictions. <br />Linle Canada Zoning Ordinance FP, Floodptain District <br />916-1 <br />
