Except in the case of non-income producing residential property, upon approval <br />of a conditional use permit the City shall be provided with a cash escrow, letter of <br />credit, cash deposit or other financial security acceptable to the City prior to the <br />issuing of building permits or initiation of work on the proposed improvements or <br />development. Said security shall be non-cancelable and shall guarantee <br />conformance and compliance with the conditions of the conditional use permit <br />and the ordinances of the City. <br />The security shall be in the amount of one and one-half (1 1/2) times the City <br />Engineer's or City Building Official's estimated costs of labor and materials for <br />the proposed improvements or development. Said project can be handled in stages <br />upon the discretion of the City Engineer and Building Official. <br />The City shall hold the security until completion of the proposed improvements or <br />development and a certificate of occupancy indicating compliance with the <br />conditional use permit and ordinances of the City has been issued by the City <br />Building Official. <br />4. Failure to comply with the conditions of the conditional use permit or the <br />ordinances of the City shall result in forfeiture of the security. <br />5. Any bond or security which has been forfeited to the City as a result of failure by <br />the applicant to comply with the conditions of the conditional use permit or the <br />ordinances of the City shall be deposited in the Little Canada General Fund. <br />E. Conditional Use Permit and Interim Use Permit Enforcement. Failure to comply with the <br />conditions of the conditional use permit, interim use permit, or the ordinances of the City <br />shall result in the conditional use permit or interim use permit being revoked by the City <br />Council. Revocation proceedings shall require a public hearing before the City Council, <br />with notice and due process according to Section 921.O10.I., except that the City Council <br />may waive Planning Commission review. In the alternative, or in addition to revocation, <br />the City may issue a citation for a specific violation in accordance with Section 925.020 <br />of this Ordinance. <br />Interim Use Permits. Interim Use Permits may be granted by the City Council where <br />allowed by Zoning District, subject to the same process as required for Conditional Use <br />Permits under this Chapter. Each Interim Use Permit shall include a requirement for a <br />recordable Development Contract between the City and the owner and applicant which <br />specifies the date and/or conditions for termination of the Interim Use Permit. Said <br />Development Contract shall be executed prior to any building, grading, or other permit <br />may be issued to the project. The use allowed by the Interim Use Permit shall terminate <br />on or before the termination period fisted in the Development Contract, and no extension <br />may be granted. Continuation of the use may be allowed only by issuance of a new <br />Interim Use Permit under the terms of this Chapter.
