factors, said information to be declared necessary to establish performance conditions in <br />relation to all pertinent sections of this Ordinance. <br />D. The applicant or a representative thereof shall appear before the Planning Commission in <br />order to answer questions concerning the proposed variance request. <br />E. The Planning Commission shall make a finding of fact and decide to recommend <br />approval or denial of said request. The Planning Commission shall reach a decision <br />within sixty (60) days after the first regular meeting at which the variance or appeal <br />request was considered by the Commission. Failure by the Planning Commission to reach <br />a decision within the time limit shall be deemed as a recommendation to the Council of <br />denial of the request. The Commission's recommendation and any City staffs report shall <br />be presented to the City Council serving as the Board of Adjustment and Appeals. <br />F. Within sixty (60) days after receiving the Planning Commission's and City staffs reports <br />and recommendation concerning a request for variance, the City Clerk shall set a public <br />hearing for the next regular meeting of the City Council sitting .as the Board o <br />Adjustment and Appeals. Notice of said hearing shall consist of a t~g~~ property <br />description, description of request and map detailing property location, and be published <br />in the official newspaper at least ten (10) days prior to the hearing. Written notification of <br />said hearing shall be mailed at least ten (10) days prior to the hearing to all owners of <br />land within three hundred fifty (350) feet of the boundary of the property in question. <br />G. Failure of a property owner to receive said notice shall not invalidate any such <br />proceedings as set forth within this Ordinance. <br />H. The City Council serving as the Board of Adjustment and Appeals shall make a finding <br />of fact and shall decide whether to approve or deny a request for a variance within thirty <br />(30) days after the public hearing on said request, or withiri the `time requixemenfs of MIS <br />Stat. Chapter,15.99; <br />Approval of this Zoning Ordinance shall require a vote of a majority of the entire City <br />Council, acting as the Board of Adjustment and Appeals. <br />The Zoning Administrator shall notify the originator of the variance request of the City <br />Council's decision, in writing. <br />922.030. LAPSE OF VARIANCE. Whenever, within one (1) year after granting a <br />variance, the use as permitted by the variance or appeal shall not have been completed or <br />utilized, then such variance shall become null and void unless a petition for extension of time in <br />which to complete or to utilize the use has been granted by the City Council. Such extension <br />shall be requested in writing and filed with the Zoning Administrator at least thirty (30) days <br />before the expiration of the original variance. There shall be no charge for the filing of such <br />petition.
