D. Planning Commission Action. The Planning Commission shall'make a recommendation <br />to'the City Council. If the Planning Commission has'not acted'upon the'preliminary plat <br />within sixty (60) days from the first meeting at which the xequest was received, the <br />Council may act on `the preliminary ''plat without the'. Planning' .Commission's <br />recommendation. <br />E. City Council Action. <br />1. Public Hearing.: Upon receipt of the application, staff reports, and Planning <br />Commission recommendation, the' City Administrator slLali sch~dtt~~ a public <br />hearing for public review of the preliminary plat. The Council shall `hold the <br />hearing and make a written finding of fact.'The notice of such hearing shall <br />contain a property description, description of request and map detailing'property <br />location, and be published in the :official newspaper at least ten. (10) days prior to <br />the hearing. Written notice of the hearing shall be mailed at least ten (10) days <br />prior to the hearing to all owners ofproperty within three hundred fifty (350) feet <br />of the boundary of the subject property. [Addresses-eurrentpractiee~ <br />Exceptions: In cases of simple subdivision (i:e. dividing one parcel into two or <br />combining two parcels into one) the Council may, when deemed appropriate, <br />waive`the requirement for public hearing. <br />2. " If alCrequirements of this'Ordinance and requirements as additionally imposed by <br />the Planning Commission are complied with, the Council shall act upon ..the <br />preliminary plat and may impose conditions and restrictions which are deemed <br />necessary within sixty (60) days of the date of the close bf the public hearing. <br />3. If the preliminary plat is not approved by the City Council, the reasons for such <br />action'shall be recorded in the proceedings of the Council and transmitted to the <br />applicant. If the preliminary plat is approved; such approval shall not constitute <br />final acceptance of the "layout. Subsequent;approvaL'will be required of the <br />engineering proposals and other features and requirements as specified by xhis <br />Ordinance to be indicated on the final plat. The City Council may require such <br />revisions in the ppreliminary plat and final plat!as it deems necessary for the health, <br />safety; general ':welfare and convenience of the City:: of Little` Canada.. Non- <br />standard improvements proposed in the subdivision may be considered a.reason <br />for denial of the.: proposah <br />a. The ;City Council may deny or require modifications''to aproposed <br />preliminary plat` when said plat :fails to comply with any of the <br />requirements of this ordinance, or other applicable regulations,"including <br />the zoning ordinance.
