NCtI2THWSST ASSOCIATED CONS~ILTANTS, iNC. <br />4800 Olson Memorial Highway, Suite 202, Golden Valley, MN 55422 <br />Telephone: 763.231.2555 Facsimile: 763.231.2561 planners@nacplanning.com <br />MEMORANDUM <br />TO: Mayor Blesener and Little Canada City Council <br />FROM: Stephen Grittman <br />DATE: September 19, 2008 <br />RE: Little Canada -Zoning and Subdivision Ordinances <br />NAC FILE: 758.10 - 07.05 <br />This memo transmits the updated Zoning and Subdivision Ordinances, with the <br />exception of the newly proposed Erosion Control and Stormwater sections which are on <br />the Council's regular agenda from the City Engineer. <br />This update includes the recent discussions on the ordinance, and incorporates the City <br />Attorney's comments related to family definitions and allowed uses in the residential <br />districts. Please note the definition of "family" and contrast it with the definition used by <br />the City of Richfield which was referenced by the Attorney in his previous <br />correspondence. This draft further corrects typographical issues identified by staff and <br />Council members. All changes are highlighted in grey, and the newest changes are <br />underlined or stricken to distinguish them from previously discussed amendments. <br />In addition to comments, questions were raised relating to the background or seeking <br />explanations for some of the regulations. I have summarized those questions and our <br />response as follows: <br />The definition of lot has been changed to require both frontage and access for a <br />lot to be buildable. A question was raised as to whether this clause would <br />prohibit a number of existing parcels to organize themselves as an association <br />and provide private access. This clause would not prohibit that kind of activity - <br />however, we still have setbacks for driveways, and additional requirements for <br />driveways that serve multiple buildings, so it is likely that in this situation, a group <br />of property owners would need to process a PUD to do something like this. <br />
