Non-Complying Work: New individual sewage treatment <br />system construction that is non-compliant, or other work on a system that <br />is non-complying, must be brought into compliance with this Ordinance <br />in accordance with a schedule established by the Department, which <br />schedule shall not exceed seven days unless the Department finds <br />extenuating circumstances. <br /> <br />15. 14. Floodplain: An SSTS shall not be located in a floodway <br />or floodplain. Location within the flood fringe is permitted provided that <br />the design complies with this Ordinance and all of the rules and statutes <br />incorporated by reference. <br /> <br /> <br />16. 15. Class V Injection Wells: All owners of new or <br />replacement SSTS that are considered to be Class V injection wells, as <br />defined in the Code of Federal Regulations, title 40, part 144, are required <br />by the Federal Government to submit SSTS inventory information to the <br />Environmental Protection Agency. <br /> <br />16. Permit Application Requirements: Construction Permit <br />applications shall be made on forms provided by the Department and <br />signed by the applicant and an appropriately certified practitioner <br />including the practitioner’s certification number and date of expiration. <br />The applications shall include the documents listed in items a through h <br />below. <br />a. The correct address and legal description of the property where <br />the proposed work is to take place. <br /> <br />b. The name and contact information (mailing address, telephone <br />number, and e-mail address) of the property owner. <br /> <br />c. The name, contact information, and MPCA License Number of <br />the SSTS Designer responsible for the system design. <br /> <br />d. Site Evaluation Report as described in Minnesota Rules, <br />Chapter 7080.1730 and on the Department’s permit application. <br /> <br />e. Design Report as described in Minnesota Rules, Chapter <br />7080.2430 and on the Department’s permit application. <br /> <br />f. Building Plans for the existing and proposed system. <br /> <br />g. Management Plan as described in Minnesota Rules, Chapter <br />7082.0600.
