12316323v3 <br />42 <br />Issuer, the Trustee, or a receiver to exercise any remedy reserved to it in this Article, it shall not <br />be necessary to give any notice, other than such notice as may be herein expressly required. In <br />the event any agreement contained in this Loan Agreement should be breached by either party <br />and thereafter waived by the other party, such waiver shall be limited to a particular breach so <br />waived and shall not be deemed to waive any other breach hereunder. <br />Section 7.04 Agreement to Pay Attorneys' Fees and Expenses. In the event the <br />Borrower should default under any of the provisions of this Loan Agreement, or the Mortgage <br />and the Issuer, the Trustee, or a receiver should employ attorneys or incur other expenses for the <br />collection of payments due or to become due hereunder or the enforcement of performance or <br />observance of any obligation or agreement on the part of the Borrower contained in this Loan <br />Agreement, or the Mortgage, the Borrower agrees that it will on demand therefor reimburse the <br />reasonable fee of such attorneys and such other expenses so incurred. <br />Section 7.05 Advances. In the event the Borrower shall fail to pay any Loan <br />Repayments under Section 4.02 hereof, or to do any other thing or make any other payment <br />required to be done or made by any other provision of this Loan Agreement, or the Mortgage, the <br />Issuer or the Trustee, each in its own discretion, may do or cause to be done any such thing or <br />make or cause to be made any such payment at the expense or as an advance for the account of <br />the Borrower, and the Borrower shall pay to the Issuer or the Trustee, as the case may be, upon <br />demand, all costs and expenses so incurred and advances so made, with interest at the rate of <br />eight percent (8.00%) per annum. Any such advance shall be entitled to priority of payment <br />from any funds thereafter received from the Borrower or under Section 7.02. <br />[The balance of this page intentionally left blank.]
