These supplement the draft amendment to <br />Section 601, Nuisances, that was submitted previously. Additionally, graffiti should be addressed under the <br />City’s sign code, Section 903.110, as a Prohibited Sign. <br />Definition <br />Graffiti: Any unauthorized writing, printing, marks, signs, symbols, figures, designs, inscriptions or other <br />drawings which are scratched, painted, drawn or otherwise placed on any exterior surface of a building wall, <br />fence, sidewalk, curb, dumpster or other such temporary or permanent structures on public or private <br />property and which has the effect of defacing the property. Graffiti may include marks, symbols, designs, <br />inscriptions or other drawings reasonably understood as communicating threats of harm, violence, contempt <br />or hatred on the basis of race, religion or gender. <br />Regulation <br />(t) Graffiti. The existence of graffiti on public or private property is expressly declared to be a public <br />nuisance because it may diminish property value, create fear, lead to additional graffiti, demean persons or <br />support youth gang activity. Therefore, it is the duty of both the owner of the property to which the graffiti <br />has been applied and any responsible party to at all times keep the property clear of graffiti. Graffiti removal <br />and corrections must be performed with materials and colors compatible with existing surfaces as determined <br />by the City. <br /> The abatement of graffiti is subject to the provisions of sub-sections 601.070 through 601.130 in <br />addition to the following removal by the perpetrator. <br /> Removal by Perpetrator. The City may also require any person applying graffiti on public or private <br />property to either remove or pay for all costs for removal of the graffiti within 72 hours after notice by the <br />City or property owner. The removal must be performed in a manner prescribed by the City, with materials <br />and colors compatible with existing surfaces, and to a condition that is comparable to or improved upon the <br />condition that existed before the graffiti application, as determined by the City. Where graffiti is applied by <br />a person under 18 years old, the parents or legal guardian will also be responsible for such removal or for <br />payment for the costs of removal. Failure of any person to remove graffiti or pay for the removal will <br />constitute an additional violation of sub-sections 601.070 through 601.100.
