<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of City Council <br /> <br />FROM: Chris Heineman, City Administrator <br /> <br />DATE: December 16, 2020 <br /> <br />RE: LMCIT Liability Coverage Waiver <br /> <br /> <br />ACTION TO BE CONSIDERED: <br />Approval to not waive our statutory tort limits. <br /> <br />BACKGROUND: <br />The Council must decide if it wishes to continue to not waive the City’s statutory tort limits for <br />liability coverage. By not waiving our statutory tort limits, we are telling the League of Minnesota <br />Cities Insurance Trust that any claims where statutory limits of liability apply will be governed by <br />those limits, i.e. $500,000 per person and $1.5 million of liability coverage. These limits had been <br />increased over the past number of years in an attempt to prevent them from being legally changed. <br /> <br />In 2015, LMCIT increased the liability limit to those potential claims not covered by statutory <br />limits of liability to $2 million (Federal civil rights claims are one example). <br /> <br />STAFF RECOMMENDATION <br />Staff recommends continuing our practice of not waiving our statutory tort limits. <br /> <br /> <br /> <br /> <br /> <br />
