<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Corrin Wendell, Community Development Director <br /> <br />DATE: January 26, 2022 <br /> <br />RE: Preliminary/Final Plat & Variance – 3000 Labore Road – Case #1407 <br /> <br /> <br /> <br />ACTION TO BE CONSIDERED <br />To consider approval of a Preliminary/Final Plat and Variances for Front Yard Setbacks, Lot <br />Widths, and Cul-de-sac Length for the property located at 3000 Labore Road, PID 04-29-22-24- <br />0015, within the R-1, Low Density Residential District as stated in the staff report contingent upon <br />completion of a Development Agreement. <br /> <br />BACKGROUND <br />The City has received a Preliminary/Final Plat and Variance application from Nathan Fair, the <br />applicant from Landmark of Little Canada, LLC for the parcel located at 3000 Labore Road. <br /> <br />The applicant is requesting approval for a major subdivision and variance for the development of <br />(15) new single-family homes. <br /> <br />At the Planning Commission meeting on November 12, 2020, the applicant presented a Concept <br />Plan/Preliminary Plat and Variance to the Planning Commission. The Variances at that time <br />included Cul-de-sac Length, Lot Width, Lot Size, Front Yard Setback, and Side Yard Setbacks. <br />The Planning Commission reviewed the case and recommended approval to the City Council. Due <br />to adjacent land being potentially available to expand this proposal, the applicant paused the <br />application and pursued the adjacent land. This item did not see the City Council at that time, <br />however after not being able to add additional land, the applicant decided to continue pursuing <br />approval for this development. The application returns to Planning Commission and City Council <br />as a Preliminary/Final Plat and Variances for Cul-de-Sac Length, Lot Width, and Front Yard <br />Setbacks. Due to the adoption of the new zoning code, Lot Size and Side Yard Setback Variances <br />are no longer necessary. <br /> <br />Current Use of Property: <br />The property currently has one single-family home located on it and the owner has recently applied <br />for a demolition permit to take down the home in preparation for development. <br /> <br />
