<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Bill Dircks, Public Works Director <br /> <br />DATE: March 24, 2021 <br /> <br />RE: Easement Agreement for Five-Start Manufactured Home Park <br /> <br />ACTION TO BE CONSIDERED: <br />Motion to approve the updated ingress/egress easement for Five-Star Mobile Estates Limited <br />Partnership over the City-owned parcel north of Twin Lake Boulevard. <br /> <br />BACKGROUND: <br />The Five-Star Mobile Home Estates manufactured home park is located in Vadnais Heights just <br />north of Twin Lake Boulevard. Back when it was first developed in 1962 a 23-foot easement for <br />ingress and egress off of Twin Lake Boulevard at Twin Lake Road was agreed upon by the City <br />of Little Canada and the park owners. The easement is one of three access points to the park <br />from the surrounding roads. It has never caused any issues for the City and the park ownership <br />has always maintained the roadway in the easement. <br /> <br />The existing ownership group is in the process of selling the park to another ownership group <br />and is cleaning up all of the title work and other issues that have been raised during sale <br />negotiations. The original easement document was pretty vague and only allowed for a 23’ <br />easement. Five-Star Mobile Estates requested a 45-foot ingress/egress easement to ensure there <br />is adequate room for the access road since it is somewhat skewed and doesn’t exactly fit in the <br />23-foot easement. Some language was also added to allow for utilities to be run through the <br />easement to serve the park should it ever become necessary. The park is currently served with <br />all utilities and the easement is not used for any but that could change in the future. <br /> <br />City staff and the City Attorney have looked at the proposed easement and made some <br />modifications and additions to ensure the City’s interests are protected and the Five-Star group <br />was amenable to those changes with some slight changes of its own. <br /> <br />Should the City-owned parcel develop in the future the City would have the right to use the <br />ingress/egress road to access the parcel if that is how it was laid out. At that time, the City could <br />opt to turn the easement road into a public street that could serve both the development parcel <br />and the manufactured home park. <br /> <br /> <br />STAFF RECOMMENDATIONS: <br />Staff recommends approving the 45-foot ingress/egress easement for Five-Star Mobile Estates <br />Limited Partnership over the City-owned parcel of land north of Twin Lake Boulevard.
