DB04/0828208.0017/13868514.5 1 <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />SPACE ABOVE THIS LINE FOR RECORDER’S USE <br /> <br />EASEMENT AGREEMENT <br /> <br /> <br /> THIS EASEMENT AGREEMENT (this “Agreement”) is made as of _______, 2021, by <br />and between the CITY OF LITTLE CANADA, a Minnesota municipal corporation (“Grantor”), <br />and FIVE STAR MOBILE ESTATES LIMITED PARTNERSHIP, a Missouri limited partnership <br />(“Grantee”). <br /> <br /> WHEREAS, Grantee owns that certain real property located in Ramsey County, <br />Minnesota, legally described on Exhibit A attached hereto and made a part hereof (the <br />“Benefited Property”); <br /> <br /> WHEREAS, Grantor owns that certain real property located in Ramsey County, <br />Minnesota, legally described on Exhibit B attached hereto and made a part hereof (the <br />“Burdened Property”); <br /> <br /> WHEREAS, Five Star Mobile Estates, a manufactured home park, was constructed on <br />the Benefited Property and includes a system of private streets a portion of which runs through <br />the Burdened Property and provides a route of ingress and egress between the Benefited Property <br />and Twin Lake Boulevard (formerly Owasso Boulevard) (such portion of the private streets <br />hereinafter the "South Portion of Bankers Drive"); <br /> <br />WHEREAS, Grantee has requested and Grantor is willing to grant an easement to <br />Grantee over a portion of the Burdened Property for purposes of using and maintaining the South <br />Portion of Bankers Drive for ingress and egress to and from Twin Lake Boulevard. <br /> <br /> NOW, THEREFORE, for good and valuable consideration, the receipt and sufficiency of <br />which is hereby acknowledged by the parties, Grantor and Grantee agree as follows: <br /> <br /> 1. Grant of Easement. Grantor hereby grants and conveys to Grantee a perpetual, <br />non-exclusive easement, for the benefit of and appurtenant to the Benefited Property, over, <br />across, under and through that portion of the Burdened Property legally described on Exhibit C <br />hereto and depicted on Exhibit D hereto (the "Easement Area"), for purposes of vehicular and
