DB04/0828208.0017/13868514.5 3 <br />no cost to Grantee, and (ii) during any period of construction, Grantor shall maintain a <br />reasonable route of direct ingress and egress between Twin Lake Boulevard and the remaining <br />portion of Bankers Drive on the Benefited Property. Upon the completion of any such <br />conversion (including without limitation the dedication of the Easement Area to the public for <br />street purposes and the physical opening of the public street) this Agreement and the easement <br />granted herein shall automatically terminate without any further action by either party and <br />Grantee's obligation to maintain the South Portion of Bankers Drive shall cease. <br /> <br /> 4. Easement to Run with Land. The parties’ respective rights and obligations under <br />this Agreement shall run with the Benefited Property and the Burdened Property and shall be <br />binding upon and inure to the benefit of the parties hereto and all persons who now or hereafter <br />have any right, title or interest in and to said properties. <br /> <br />5. Amendment. This Agreement may be amended only by an instrument signed by the <br />parties hereto or their respective successors and/or assigns <br /> <br /> 6. Governing Law.
