MINUTES <br />CITY COUNCIL <br />SEPTEMBER 24, 2008 <br />EROSION The City Engineer reviewed the proposed Erosion Control <br />CONTROL Ordinance, which he noted has similarities to the Stormwater <br />ORDINANCE Management Ordinance. This ordinance establishes guidelines for <br />controlling disturbed areas via silt fencing, street sweeping, etc. Any <br />project consisting of 20,000 square feet of disturbed area would be <br />required to complete a SWPPP and submit it for approval. <br />Keis asked if Fra-Dor would be subject to this ordinance. The Engineer <br />thought that was a possibility. The Engineer noted that at a minimum <br />there should be perimeter controls for the Fra-Dor site. <br />The Engineer noted that the ordinance provides for some flexibility in <br />requirements should the City determine that the chance of erosion is not <br />high based on particular circumstances. The ordinance allows the City the <br />ability to reduce or increase requirements on a case-by-case basis <br />depending on specific circumstances. <br />The City Engineer noted that the Building Official will be responsible to <br />ensure that the ordinance is being complied with in many cases. For <br />example, when the Building Official is conducting footings inspections, he <br />will ensure that the proper silt fencing is in place. <br />The Engineer noted that the ordinance also provides for the processing of <br />variance requests. However, it is unlikely there would be much cause to <br />grant a variance from erosion control standards. <br />The Engineer again noted the requirement for financial security. This <br />security could be used should a developer fail to put erosion control <br />methods in place. <br />The Council was in support of the Erosion Control Ordinance as proposed <br />by the City Engineer. <br />ZONING The City Planner began a review of the proposed amendments to <br />CODE the City's Zoning Code, which has been reviewed by both the Planning <br />Commission and City Council at several previous meetings. The Planner <br />noted that he changed the City's definition of family to that used by the <br />City of Richfield as was commented on by the City Attorney at a previous <br />meeting. It was also noted that the Code requires that there be adequate <br />off-street parking for all residential properties. The Planner further noted <br />that he has amended the Code to update the definition of day care to meet <br />State standards. <br />
