discretion, may require Developer to forfeit the financial guarantee ,and the City shall retain the entire amount of such financial guarantee or at its option use the financial guarantee to complete part or all of the Improvements. The City shall not be required to provide any notice or procedures other than those contained within the financial guarantee document filed with the City. The City shall have the right to enter upon the property to inspect work or complete all or a portion of the Improvements as necessary. In the event the City does any such work, the City may, in addition to its other remedies, assess against the Property any costs that the City incurs which exceed the amount of the financial guarantee. 11. Developer shall be responsible for any Water Availability Charges and/or Sewer Availability Charges associated with any improvements made to the building that trigger their application, including any charges imposed by Metropolitan Council Environmental Services that may become due with any building permits required by improvements to The Property. 12. Due to the tack of general maintenance and repair that to the existing structure on The Property, Developer agrees to complete the following work by no later than July 1, 2008: • Removal of all rank growth of trees and weeds around perimeter of building and in the fenced area along the west side of the property. • Paint portion of east wall to closely match color of the majority of the adjoining surface. Said area to be painted is roughly l0 feet by 16 feet in size. • Maintain all landscaped/grass area in a manner consistent with Little Canada nuisance codes to ensure that rank growths of weeds are prevented and that grass is mowed to reasonable standards. • Bring the existing pylon sign located at the northwest corner of the property into conformance with City codes related tc signage at the time Midwest Gymnastics occupies the property and a face change is to be done on the existing pylon sign. a 9
