<br />Based on the feedback provided by the City Council, staff drafted amendments to Ordinance 855 <br />including new definitions for Designated Offender, Licensed Chile Care Facility, Permanent <br />Residence, Temporary Residence, Public Parks or Fishing Piers, and Schools. The amendments <br />also include a detailed description of how to measure the radius of an Exclusion Zone. The radius <br />areas are around all Pre-K through grade 12 schools and parks, including these that are in adjacent <br />cities where the radius boundary spills over into Little Canada. There is also a radius area around <br />all licensed daycares (centers & in-home daycares) that are located only in Little Canada. <br /> <br />The revised ordinance language also narrows the scope of who this ordinance will pertain to and <br />limits the ordinance to a designated offender who has been assigned as a Risk Level III predatory <br />offender pursuant to Minn. Stat.244.052, or any person who otherwise is required to register with <br />the state department of corrections and been assigned as a Risk Level III predatory offender. <br />Additional information on Risk Level I to Risk Level III is attached for your information. <br /> <br />The radius of the Exclusion Zone continues to be 500 feet as it was in the previous ordinance. <br />There are three maps attached that show a 500-foot radius, 750-foot radius and 1,000-foot radius <br />around local parks, schools and daycare facilities for your reference. The parcels shown in yellow <br />on the maps designate properties that are completely outside of all radius circles and are where a <br />Level III Predatory Offender could live. <br /> <br />STAFF RECOMMENDATION: <br />Staff has consulted with the City Attorney’s office and they have reviewed and recommend <br />approval of the draft amendments to Chapter 2204 as proposed. Staff recommends adoption of <br />Ordinance 855, Amending City Code Chapter 2204, Exclusion Zones & Prohibition of Certain <br />Employment-Related Activities, and authorize summary publication of the ordinance. <br /> <br /> <br />
