<br /> <br /> STAFF REPORT <br /> <br /> <br />TO: Planning Commission Members <br /> <br />FROM: Chris Heineman, City Administrator <br /> <br />DATE: September 12, 2019 <br /> <br />RE: Fra-Dor Interim Use Permit – Recycling/Stockpiling in the I-2 Zoning District <br /> <br />Background and Analysis: <br />Fra-Dor is seeking a renewal of their Interim Use Permit to allow continuation of aggregate stockpiling <br />and recycling operation on their site at 3137 Country Drive. The site is zoned I-2, General Industrial, <br />which allows this type of use by Interim Use Permit. The purpose of the “I-2” General Industrial <br />zoning district is to provide for the stockpiling of aggregate materials on an interim basis, along with <br />related and limited industrial activities, with an emphasis on high standards for building quality, site <br />design, and control of nuisance and pollution concerns. It is anticipated that upon termination of the <br />stockpiling use, the property will be rezoned to accommodate a permanent and compatible land use. <br />The specific language of the interim use clause in the zoning code reads as follows: <br /> <br />914-A.030. INTERIM USES. The following are interim uses in the “I-2” District, subject to <br />the issuance of an Interim Use Permit, per the procedures as listed in Section 921 of this <br />Ordinance. <br /> <br />A. Aggregate Materials Stockpiling and/or Recycling, subject to the following conditions: <br />1. The use is found to be consistent with the existing land uses in the area and with <br />the underlying land use plan for the district in which it is located. <br />2. The use is screened with earth berms and landscaping from the adjacent streets to <br />a minimum height of ten feet. <br />3. The operation of the facility includes measures which keep vehicles from <br />spreading mud, dirt, dust, or debris off of the site onto adjacent public roadways. <br />4. The operation of the facility includes measures for controlling the creation of dust <br />and other particulate matter through watering of the materials, or other methods. <br />5. Other conditions or requirements as specified by the City Council deemed <br />necessary to keep the site from becoming a nuisance to the public or to adjoining <br />property owners. <br />6. The aggregate materials stockpiling and/or recycling operation must be the <br />exclusive use of the property subject to the permit, and shall not be mixed with <br />other land uses, whether permitted or conditional. <br />7. The applicant/operator of the facility posts a financial security guaranteeing <br />compliance with the conditions listed in the permit approval. <br />Little Canada Zoning Ordinance I-2, General Industrial District <br />914-A-2 <br />8. The applicant/operator of the facility executes an interim use development <br />agreement specifying the conditions of approval, the amount and form of the <br />security to be posted, and the termination date of the interim use.
