Chpater 902 General Provisions Severability <br />Page 2-4 <br />(b) An applicant with a pending application may waive the review available under 1 <br />the prior ordinance through a written letter to the Planning Director, and instead 2 <br />request review under the provisions of this ordinance. 3 <br />1. Approved Projects 4 <br />(a) Approved land use and other related actions by the City of Little Canada authorized 5 <br />under the prior ordinance, including Building Permits that are valid on the effective 6 <br />date of this ordinance, shall remain valid until their expiration date, where 7 <br />applicable. 8 <br />(b) Projects with valid approvals or permits shall comply with the requirements of this 9 <br />ordinance where the standards will not materially affect the project. Where use of 10 <br />these standards would materially affect the project, the project shall be completed 11 <br />pursuant to the development standards in effect at the time of approval, provided 12 <br />that the permit or approval is valid and has not lapsed. 13 <br />(c) Any building or development for which a Building Permit was granted prior to the 14 <br />effective date of this ordinance shall be permitted to proceed as permitted or 15 <br />approved, even if such building or development does not conform to the provisions 16 <br />of this ordinance, as long as the Building Permit remains valid. 17 <br />(d) Building permits authorized in accordance with the ordinance existing prior to the 18 <br />effective date of this ordinance shall still be valid, but shall not be renewed if the 19 <br />permit expires. All future permits shall only be issued if in compliance with the 20 <br />requirements of this ordinance. 21 <br />902.070 Severability 22 <br />A. Provisions 23 <br /> If any court of competent jurisdiction invalidates any provision of this ordinance, then such 24 <br />judgment shall not affect the validity and continued enforcement of any other provision of 25 <br />this ordinance. 26 <br />B. Properties 27 <br /> If any court of competent jurisdiction invalidates the application of any provision of this 28 <br />ordinance to a particular property, structure, or situation, then such judgment shall not affect 29 <br />the application of that provision to any other building, structure, or situation not specifically 30 <br />included in that judgment. 31 <br />C. Approvals 32 <br /> If any court of competent jurisdiction rules invalid any condition attached to an approval 33 <br />under this ordinance, then such judgment shall not affect any other conditions or 34 <br />requirements attached to the same approval that are not specifically included in that 35 <br />judgment. 36 <br />D. Administrative Actions 37 <br /> Whenever a condition or limitation is included in an administrative action authorizing 38 <br />regulatory activity, then it shall be conclusively presumed that the authorizing officer, 39 <br />commission, or board considered such condition or limitation necessary to carry out the spirit 40 <br />and intent of this ordinance, and that the officer, commission, or board would not have 41 <br />granted the authorization to which the condition or limitation pertained except in the 42 <br />determination that the condition or limitation was lawful. 43
