<br />MEMORANDUM <br /> <br />Date: Thursday, April 29, 2021 <br /> <br />To: Chair Schwalbach and Planning Commission <br />From: Corrin Wendell, AICP, Community Development Director <br />CC: Chris Heineman, City Administrator <br />Re: Text Amendment – Sections 912.020, 912.040, 912-A.020, 912-A.040 <br /> <br />BACKGROUND <br /> <br />Chair Schwalbach and Planning Commission members: <br /> <br />The Planning Commission is asked to make a recommendation on Text Amendments for Massage <br />Therapy and Tattoo/Body Art within the Zoning Code in certain districts. <br /> <br />Proposal: <br />The City is bringing forward text amendments to update the Zoning Code to include allowance <br />as a permitted use, Massage Therapy and Tattoo/Body Art. The City has received requests for <br />these types of uses, but one of the uses was not listed in these two zoning districts and the other <br />is currently a Conditional Use Permit. In order align with future Zoning Code update language, <br />be business friendly, and provide less hurdles for these types of businesses, the amendment is <br />necessary to move ahead of the Update schedule, which would be later this year. Back in 2007, <br />Ordinance 633 allowed Tattoo/Body Art in Section 915 listed as a special use and not a <br />conditional use, but only in the PUD zoning district and was never incorporated into the zoning <br />code, this is now an opportunity to integrate that language into the code where appropriate. <br /> <br />FINDINGS <br />What is a Text Amendment? <br />A text amendment is a change or update to the Zoning Code that requires a public process. <br />Approved changes will be reflected within the Zoning Code document. <br /> <br />Text Amendment Proposal: <br />The proposal language includes new language (underlined) and removed language <br />(strikethrough) in the various Sections below: <br />B-3, General Business District, Section 912.020 Permitted Uses <br />RRR. Massage therapy as a principal or accessory use, provided that the business receives the <br />appropriate licenses from the City, and complies with all requirements of Section 2201-2203. <br /> <br />SSS. Tattoo/Body Art as a principal or accessory use, provided that the business receives the <br />appropriate licenses from the City, and complies with all requirements of Section 822. <br />
