<br />FINDINGS <br /> <br />Zoning: <br />The property is within the R-1, Single Family Residential District. City Code Section 903.020 <br />(D)(2), General Provisions allows for detached garages by Conditional Use Permit to be placed in <br />the side yard of the property. <br /> <br />What is a Conditional Use Permit? <br />CUP is an abbreviation for Conditional Use Permit. A Conditional Use Permit is a use that is <br />permitted in a zoning district under the Zoning Ordinance, if certain conditions, designated by the <br />City Council, Planning Commission, or specified in the Zoning District, are met. <br /> <br />City Code Section 903.020 (D)(2)(b)(1-5): <br />Upon approval of a conditional use permit, one accessory building or garden shed may be located <br />within a side yard, but shall be no closer to the front line of a lot than the front building line of the <br />principal structure. The issuance of a conditional use permit for location within the side yard shall <br />be considered to be a special exception, conditioned upon factors including, but not limited to, the <br />following: <br />(1) The accessory building or garden shed is screened from the view of the public street with <br />fencing and/or landscaping. <br />(2) The architectural appearance of the accessory building or garden shed is reasonably <br />coordinated with the principal structure. No corrugated metal siding or roofing shall be allowed. <br />(3) Placement of the accessory building or garden shed shall not detract from the appearance of <br />the streetscape and shall be consistent with the character of the neighborhood. <br />(4) The accessory building or garden shed complies with all other provisions of this section. <br />(5) The provisions of Section 921.030 (Yard Requirements) of this Ordinance are considered and <br />met. <br /> <br />The applicant complies with these standards. <br /> <br />City Code Section 903.020 (D)(3) and (4): <br />Accessory buildings in residential zoning districts shall not exceed fifteen (15) feet in height, shall <br />not be closer than six (6) feet to any other building or structure on the same lot, and shall not be <br />located within a public drainage, utility or access easement. Subject to other provisions as <br />contained in this section, accessory buildings, uses and equipment may encroach into the required <br />rear yard, but in no case shall an accessory building, use or equipment be located closer than ten <br />(10) feet to a rear yard or side yard lot line except as may be specifically modified by this section <br />or a specific use district. <br /> <br />No accessory building or detached garage for a single-family dwelling shall occupy more than <br />twenty-five (25) percent of the area of the rear yard. The total floor area of a garage and other <br />accessory buildings for a single family detached dwelling shall not exceed one thousand (1,000) <br />square feet of floor area per lot, except by conditional use permit pursuant to Section 921 of this <br />Ordinance. In no instance shall the total floor area of a garage and an accessory building for a <br />single-family dwelling exceed one thousand five hundred (1,500) square feet. No Conditional Use <br />Permit shall be issued for detached accessory building or garage area of more than one thousand
