STAFF REPORT <br />TO: Parks and Recreation Commission <br />FROM:Corrin Wendell, Community Development Director <br />Bryce Shearen, CPRP, Parks & Recreation Director <br />DATE: March 3, 2022 <br />RE: Park Dedication Fee – 3055 Spruce Street <br />ACTION TO BE CONSIDERED <br />To consider the recommendation to the City Council for the acceptance of a Park Dedication Fee <br />for the parcel located at 3055 Spruce Street PID 062922210040 in the amount of $26,657.68, <br />which is 7% of the fair market value of the land (FMV). <br />BACKGROUND <br />The City has received a building permit application from Dan Oren from Dart Transit Company <br />to construct a new warehouse facility on the vacant parcel located at 3055 Spruce Street, Little <br />Canada, MN 55117. As part of the City Code Chapter 2101, the city requires a park dedication <br />fee for all residential, commercial, or industrial land that is to be developed. <br />In all subdivisions, as defined by Minnesota Statutes 1980, Section 462.352, for residential, <br />commercial, industrial or other uses or as a planned unit development which includes residential, <br />commercial and industrial uses, or any combination thereof, where the City Council deems it <br />appropriate, a reasonable portion of each proposed development shall be dedicated to the public <br />for public use as parks, playgrounds, public open space or stormwater holding pond areas, or, at <br />the option of the City, the person or firm proposing the development shall donate to the City an <br />amount in cash in lieu of land. <br />Park dedication can be received either in dedication of land or cash in lieu of land. In each <br />development of new land, it is determined by the City which one will be received. If there is land <br />dedication available on the site that aligns with the City’s Park Master Plan and 2040 <br />Comprehensive Plan, then that is preferred, or if there is not land that would align with the City’s <br />goals and policies for parks and open space, then cash in lieu of land is preferred. Each <br />development proposed to the City gives the opportunity to look at both options and choose the <br />one that is best suited for the City’s goals and vision for Parks and Open Space. The image <br />below is from the Park System Master Plan which shows that the parcel for the new construction <br />is within access to parks and open spaces. <br />Per Little Canada City Code, cash donations received pursuant to the provisions of this Chapter <br />shall be held in a special fund and used only for the purposes of land acquisition, land <br />development and capital outlay for parks, playgrounds, public open space, storm water holding
