D. The applicant is responsible for inspections and maintenance on the site. Inspections <br />must be documented and occur once every 7 days on exposed soil areas, within 24 hours after a <br />1 /2-inch rain event over 24 hours, once every 30 days on stabilized areas, and as soon as runoff <br />occurs or before resuming construction on fiozen ground. The applicant must maintain the site <br />by removing sediment within 24 hours when it reaches 1/3 the height of the BMP on perimeter <br />control devices, repairing or replacing any failing perimeter control device within 24 hours, <br />draining or removing sediment from basins within 72 hours when sediment reaches % the outlet <br />height or''/z the basin storage volume, and removing sediment from paved surfaces within 24 <br />hours of discovery. <br />E. Review -The city must complete a review of the SWPPP concurrent with the grading <br />and erosion control plan from the developer. Written documentation of SWPPP approval must <br />be had before commencement of any work. If the City denies the SWPPP, the SWPPP must be <br />resubmitted and approved before the land disturbance activity begins. All land use and building <br />permits must be suspended until the SWPPP is approved. The City must conduct regular <br />inspections to ensure that erosion and sediment control measures are properly installed and <br />maintained, Charges for the inspection will be assessed pursuant to an annual fee schedule. If <br />cooperation is withheld, the City must issue construction stop work orders and work cannot <br />commence until an inspection is passed. <br />F. Modification of Plan. The applicant must amend the SWPPP whenever there is a <br />significant effect on the discharge of pollutants to surface or underground waters, inspections <br />indicate the SWPPP is not effectively eliminating or minimizing the discharge of pollutants, or <br />The SWPPP is not controlling pollutants or is not consistent with the terms and conditions of the <br />permit. <br />G. Variance Requests. The City may grant a variance on a case-by-case basis. Requests for <br />a variance must be in writing and include the reason for the request. Economic hardship is <br />insufficient for granting a variance. The applicant will be required to provide the City with a <br />financial security if the variance is granted. <br />H. Maintaining the Financial Security. If at anytime during the work the financial security <br />falls below 50% of the required deposit, the City may require the developer to deposit the <br />amount necessary to restore cash deposit to the required amount. If the developer fails to do so <br />within 7 days after notification by the City, the City may withhold inspections, certificates, or <br />revoke permits. <br />I. Action Against the Financial Security. The City may assess financial security if work is <br />abandoned prior to completion of grading, work does not conform to SWPPP, protective <br />measures fail within one year of installation, or the City is not reimbursed for corrective action. <br />J. Emergency Action. If noncompliance with this ordinance poses an immediate danger to <br />the public health, safety, and welfare as determined by the City, the City may take emergency <br />preventative action and any cost may be recovered from the applicant's financial security. <br />
