MINUTES <br />CITY COUNCIL <br />OCTOBER 21, 2008 <br />Ms. Allan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2008-10-260 -ADOPTING THE ASSESSMENT <br />ROLL FOR IMPROVEMENT NO. 2008-06, BEAMAVENUE, FOR <br />STREET RECONSTRUCTION, CONCRETE CURB AND GUTTER, <br />WATERMAIN, AND DRAINAGE ENHANCEMENTS, AS <br />RECOMMENDED BY THE CITY ENGINEER <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (4). <br />Nays (0). Resolution declared adopted. <br />IMP. NO. Mayor Blesener opened the Public Hearing at 7:30 p.m. to consider <br />2008-02 - to consider adoption of assessment roll for Improvement No. 2008-02, <br />CONDIT Condit Street from Nadeau Road to South Owasso Blvd. by road <br />STREET reconstruction, concrete curb and gutter, and drainage enhancements. <br />The City Engineer indicated that the Condit Street project has been <br />delayed while the contractor is waiting for private utilities to move power <br />poles. The work is scheduled to be done this week and then street grading <br />will resume. The Engineer indicated that it is hoped concrete curb and <br />gutter will be installed by Thursday. <br />The City Engineer reviewed both the feasibility estimate for the Condit <br />Street improvement as well as the actual estimated cost. Actual estimated <br />cost is $325,528.21, with $132,393.86 of that amount proposed to be <br />assessed to benefitting property owners. <br />The Engineer reviewed the City's Residential Assessment Policy noting <br />that street reconstruction costs are capped at $57.97 per front foot. There <br />are four residential properties abutting the project. <br />The Engineer noted that there are eight commercial properties abutting <br />Condit Street. He indicated that due to the limited or restricted access to <br />Condit Street, commercial properties are proposed to be assessed at the <br />residential rate for their total frontage, rather than the commercial rate. <br />The Engineer reported that this is adjustment is in response to the <br />comments made by Nicollet Partners in their review of the special <br />assessments proposed for the project. The City Engineer noted that the <br />Zoch property is zoned commercial but utilized as residential. He <br />indicated that the Zoch would be able to apply for a development deferral <br />for the assessments over the 125 foot frontage maximum in place for <br />residential properties, if they so desire. Those assessments would only <br />become due should the property use change to commercial. <br />
