real property that was owned by Mr. Lincoln. Unfortunately staff was unable to find any <br />personal or business property under the ownership of Mr. Lincoln. It also appears that the <br />Lincoln Group, LLC is no longer a legal business entity. <br />City staff initially began meeting with a real estate broker and representatives of the Sculley <br />family in 2020 about the proposed development for the Gervais Woods 2nd Addition. The <br />outstanding debt was also addressed at that time, and the former property owner once again <br />refused to take responsibility for any of these charges. <br />In contrast to the former concept review, the process for the Gervais Woods 2nd Addition has <br />gone very well. The developer paid all of the required fees for the variance process as well as <br />the preliminary and final plat process. In addition, staff negotiated the remaining fees and <br />escrows related to this subdivision which are included in a formal Development Agreement. <br />RECOMMENDATION <br />Staff recommends that the City Council approve a motion to write-off uncollectable debt in the <br />amount of $6,328.82 for outstanding developer fees for the Lincoln Group that were incurred <br />between July 2016 – April, 2017.
