<br /> C-2 <br /> <br />(i) _________, ____ (the date which is 15 years after the date on which 50% <br />of the residential units in the Project were occupied); <br /> <br />(ii) the first day on which no tax-exempt private activity bond issued with <br />respect to the Project is outstanding, or <br /> <br />(iii) the date on which any assistance provided with respect to the Project under <br />Section 8 of the United States Housing Act of 1937 terminates. <br /> <br />5. As of the date of this Certificate, the following percentages of completed residential <br />units in the Project are (i) occupied by Low Income Tenants or (ii) currently vacant and being held <br />available for occupancy by Low Income Tenants and have been so held continuously since the <br />date a Low Income Tenant vacated such unit, as indicated: <br /> <br />Occupied by Low Income Tenants _____ % Units Nos.____ <br /> <br />Continuously held vacant for occupancy by <br />Low Income Tenants since last occupied by <br />Low Income Tenants <br />_____ % Units Nos.____ <br /> <br />6. At no time since the date of filing of the last Continuing Program Compliance <br />Certificate (or since the issuance of the Note, if this is the first such certificate) has less than _____ <br />units representing 20% of the completed units in the Project been occupied by or were last occupied <br />by Low Income Tenants. <br /> <br />7. As of the date of this Certificate, at least 40% of the units in the Project are <br />(i) occupied by persons or families with Adjusted Income which does not exceed 60% of the <br />Median Income for the Area adjusted for household size; or (ii) held vacant for occupancy for <br />persons or families with Adjusted Income which does not exceed 60% of the Median Income for <br />the Area adjusted for household size. Project Units occupied or held vacant for persons or families <br />with Adjusted Income which does not exceed 60% of the Median Income for the Area adjusted for <br />household size include Unit numbers _____________________________________________. <br /> <br />8. At all times since the date of filing of the last Continuing Program Compliance <br />Certificate rent on at least 20% of the units in the Project has been equal to or less than applicable <br />area fair market rents or exception for fair market rents, established from time to time by the United <br />States Department of Housing and Urban Development. <br /> <br />9. To the knowledge of the undersigned, after due inquiry, all units were rented or <br />available for rental on a continuous basis during the immediately preceding year to members of <br />the general public, and the Owner is not now and has not been in default under the terms of the <br />Regulatory Agreement and the Loan Agreement and, to the knowledge of the undersigned, no <br />Determination of Taxability has occurred with respect to the Note. <br /> <br />10. [CHOOSE ONE: None/One or more] of the Tenants in the Project are currently <br />receiving assistance under Section 8 of the United States Housing Act of 1937.
