<br /> <br /> STAFF REPORT <br /> <br /> <br /> <br />TO: Mayor Keis and Members of the City Council <br /> <br />FROM: Heidi Heller, City Clerk <br /> <br />DATE: June 20, 2022 <br /> <br />RE: Ordinance 865, Amending Ch. 602, Prohibition of Certain Open Fires on <br />Balconies <br /> <br /> <br />ACTION TO BE CONSIDERED: <br />Consider adoption of Ordinance 865 amending City Code Chapter 602, Prohibition of Certain <br />Open Fires on Balconies. <br /> <br />BACKGROUND: <br />The City Inspectors often use City Code Chapter 602 to notify residents that grills and any open <br />flames are not allowed on balconies. City Code Chapter 2001 references the city’s adoption of <br />the Minnesota Fire Code, which was most recently done in 2020. Chapter 602 makes reference <br />to the specific Fire Code and appendix for fires on balconies. This chapter was not updated for <br />the 2020 Fire Code adoption. Rather than having to update multiple city code chapters each time <br />a new Fire Code is adopted, staff is recommending that Chapter 602 be amended to reference <br />Chapter 2001, which will always have the current adopted Fire Code information. <br /> <br />Recommended amendment to City Code Chapter 602.010: <br /> <br />602. PROHIBITION OF CERTAIN OPEN FIRES ON BALCONIES <br /> <br />602.010. DECLARATION OF POLICY. On March 22, 2017, the Little Canada City <br />Council adopted the 2015 Minnesota State Fire Code including Appendix “K” Per City Code <br />Chapter 2001, the Little Canada City Council has adopted the Minnesota State Fire Code, <br />including the Appendix relating to the prohibition of fires or barbecues on balconies or patios. The <br />purpose of this appendix is to prevent tragedies from occurring as a result of such activities. <br /> <br />602.020. OPEN FLAME PROHIBITED. In any structure containing three or more <br />dwelling units, no person shall kindle, maintain, or cause any fire or open flame on any balcony <br />above ground level, or on any ground floor patio within 15 feet of the structure. <br /> <br />602.030. FUEL STORAGE PROHIBITED. No person shall store or use any fuel, <br />barbecue, torch, or other similar heating or lighting chemical or device in the locations designated <br />in Section 602.010. <br />
