MINUTES <br />CITY COUNCIL <br />DECEMBER 22, 2008 <br />terms of that takeover. O' Hara reported that Mr. Thao has been open <br />more days than he is allowed under the agreement. Based on that, Mr. <br />Thao should be vacating the space January 3, 2009. O'Hara reported that <br />based on the incidents that have taken place, she would hope the Council <br />would take a proactive approach and revoke the Bangkok licenses. <br />O'Hara also reported that the Sheriff's Department has many concerns <br />with this business and the potential for what might happen. O'Hara also <br />reported that based on her observations the maximum capacity under the <br />fire codes is being exceeded substantially at some events. <br />Blesener asked if O'Hara had events planned in the Bangkok space at this <br />time. She replied that she did not. She and the landlord are waiting for <br />the space to be vacated so that tenant improvements can be made. After <br />that, additional dates will be planned by Heritage Theater. <br />Thao again reported that he has holiday events scheduled and asked that <br />the Council allow him to operate to fulfill these commitments. He again <br />indicated, that after that time he will voluntarily give up his licenses. <br />O'Hara reported that under the agreement she has with Mr. Thao, and <br />based on the fact that he operated more days than what was allowed, the <br />following dates would be available to Bangkok Avenue: December 24, <br />25, 26, 27, 28, 31, January 1, 2, and 3. <br />Mr. Thao explained O'Hara comments about the additional dates. He <br />indicated that the agreement stated that he could be opened on weekends, <br />therefore, he operated his business on Fridays, Saturdays, and Sundays. <br />O'Hara stated that Sunday operations were not allowed under the <br />agreement. Thao expressed concern about O'Hara's involvement in <br />encouraging the Council to revoke his liquor license. <br />Allan reported that O'Hara has nothing to do with the consideration of <br />suspension or revocation of the Bangkok Avenue licenses. That <br />consideration is before the Council based on the incidents that have been <br />occurring at the business. Allan noted that other businesses in the area are <br />complaining, there have been serious incidents at Bangkok, the Sheriff's <br />Department has serious concerns with the business. Allan noted that Mr. <br />Thao has made promises as to how he will conduct the business, and he <br />has not followed through on those promises. Allan informed Mr. Thao <br />that he has brought these problems on and they were caused by the way he <br />has operated his business. Allan indicated that she was concerned there <br />would be a fatality or someone would be seriously hurt at Bangkok <br />Avenue. <br />17 <br />
